The Department of Public Works for the Town of Secaucus, shall include a Division of Streets and a Division of Buildings and Grounds.
A. 
(1) 
Position. The position of Superintendent of the Department of Public Works is hereby established, who shall be appointed by the Mayor and Council. The Superintendent of the Department of Public Works shall serve as the Town's Principal Public Works Manager pursuant to N.J.S.A. 40A:9-154.6(a)(e).
(2) 
Duties. The Superintendent of Public Works shall be in administrative control of the Department of Public Works, and shall direct and supervise Assistant Superintendents. He shall perform administrative duties and planning relating to the installation, maintenance and repair of public works facilities, and assist in planning, organizing and directing all programs related to Town public works activity, all as directed from time to time by the Town Administrator and/or the Mayor and Council, in proper compliance and administration of the various laws, regulations, technical practices, operations and management conducted by the Town of Secaucus. It shall be the duty of the Superintendent to assist the Town Administrator in developing a proposed budget for the Department of Public Works. The Superintendent shall keep accurate records of the work undertaken by employees of the department, including the time devoted by each employee thereto; to examine all claims for payment for his department, and to certify the accuracy of such claims or append his criticism of same thereto. He shall keep accurate records of all materials and vehicles used by employees of his department.
(3) 
Qualifications. No person shall be appointed as Superintendent of the Department of Public Works unless:
(a) 
He is a citizen of the United States and of the State of New Jersey, residing in the Town of Secaucus.
(b) 
He is at least 18 years of age and is in good health and physically fit and qualified to perform the duties required of him pursuant to the terms of this chapter.
(c) 
He shall possess a valid New Jersey Driver's License.
(d) 
He shall possess a certified Public Works Manager certificate, or shall be eligible to acquire same within two years of appointment in accordance with the requirements of N.J.S.A. 40A:9-154.6a(g).
(4) 
Compensation. Compensation for the Superintendent of the Department of Public Works shall be set forth in the Annual Salary Ordinance.
B. 
(1) 
Position. The positions of Assistant Superintendent are hereby established, and shall be appointed by and serve at the pleasure of the Mayor and Council. They shall be supervised and shall perform their duties at the direction of the Superintendent.
(2) 
Duties. The duties of the Assistant Superintendents shall be to exercise authority and control over the day-to-day operations of their division, to determine, schedule, supervise and control the work to be accomplished, to assign, direct, and exercise discipline and control over such employees as may be under his supervision; and to perform such other related duties as may from time to time be assigned by the Superintendent, the Mayor and Council or Town Administrator.
(3) 
Compensation. Compensation for the positions of Assistant Superintendent shall be as set forth in the Annual Salary Ordinance.
C. 
(1) 
Position. The positions of Division Coordinator/ Foreman, and Division Coordinator/Animal Control Officer are hereby created, the appointees to such positions being appointed by and servicing at the pleasure of the Mayor and Council.
(2) 
Duties. The duties of the respective Division Coordinator/Foreman and Division Coordinator/ Animal Control Officer shall be as follows:
(a) 
The Division Coordinator/Foreman of Fields, Parks and Landscaping shall report to and perform such duties within his assigned area as may be directed by the Assistant Superintendent, or the Town Administrator, all under the direction of the Mayor and Council.
(b) 
The Division Coordinator/Foreman of Recycling, Rubbish and Roads shall report to and perform such duties within his assigned area as may be directed by the Assistant Superintendent, or the Town Administrator, all under the direction of the Mayor and Council.
(c) 
The Division Coordinator/Foreman of Buildings and Grounds shall report to and perform such duties within his assigned area as may be directed by the Assistant Superintendent, or the Town Administrator, all under the direction of the Mayor and Council.
(d) 
The Division Coordinator/Animal Control Officer shall report to the Assistant Superintendent of Buildings and Grounds and perform such duties as are delegated to him by Chapter 67 of the Municipal Code of the Town of Secaucus in addition to such other duties as may be assigned to him by the Assistant Superintendent, or the Town Administrator, all under the direction of the Mayor and Council.
(3) 
Compensation. Compensation of the Division Coordinator/Foreman and Division Coordinator/ Animal Control Officer shall be as set forth in the Annual Salary Ordinance.
D. 
(1) 
Positions. Two positions of Foreman are hereby created, the appointees to such positions being appointed by and serving at the pleasure of the Mayor and Council.
(2) 
Duties.
(a) 
Any Foreman shall perform such duties as assigned to him by the Assistant Superintendent.
(3) 
Compensation. The compensation for the position of Foreman shall be set forth in the Annual Salary Ordinance.
E. 
(1) 
Positions. In addition to the above, the following employees are hereby designated as employees of the Department of Public Works, and shall be assigned to the following divisions:
Division of Streets
Division of Buildings and Grounds
Mechanic
Maintenance Worker
Assistant Mechanics
Laborer-Drivers
Maintenance Worker
Custodian
Animal Control
Transportation/Medical Escort
Labor-Driver
Custodian
Clerk
Housekeeper
Interlocal Carpenter
Interlocal Plumber
(2) 
Supervision. Such employees shall be supervised and perform their duties at the direction of the Assistant Superintendent of the Department of Public Works, to whose division they are assigned.
(3) 
Compensation. Compensation shall be in accordance with the Annual Salary Ordinance and in accordance with the employees' labor union contract.
The employees of the Department of Public Works shall be subject to such rules and regulations as may be established by the Superintendent, with the approval of the Mayor and Council.
A. 
(1) 
Emergency sewer pipe cleaning. If the Department of Public Works determines that it is in the best public interest to perform emergency sewer pipe cleaning for situations when a blockage occurs between the main sewer line and a residence, when the residence is adjacent to a public street (designated roadway), such property owner shall compensate the town of Secaucus at the flat rate of $60 per call.
(2) 
For the purpose of this chapter, emergency calls shall be defined as calls occurring before or after the normal working hours of the Department of Public Works, or holidays.
(3) 
(a) 
The Mayor and Council and/or the Department of Public Works shall establish rules and regulations covering the provision of such service.
(b) 
All monies collected for this service shall be deposited in the general treasury of the Town of Secaucus.
(c) 
Nothing herein shall compel the Town of Secaucus to perform work in situations where the Department of Public Works believes it is not in the best interests of the Town to provide such service.
B. 
Dumpster dumping services and costs. The Town of Secaucus, at the request of a resident/homeowner, subject to availability and at the discretion of the town, will station a Department of Public Works dump truck-type vehicle curbside, only on Saturdays, only between the hours of 7:00 a.m. and 11:00 a.m., to be available to be loaded with bulk debris by the resident/homeowner, only under circumstances when the resident/homeowner is performing reconstruction work himself/herself without the assistance or involvement of a home improvement contractor or other contractor. Town's forces will dump the debris placed therein. The resident/homeowner will be obliged to pay all dumping costs incurred by the town based upon the gross weight within 15 days of receiving an invoice for the same. The cost of the same will be based upon the town's contract for rubbish disposal. Under no circumstances will the vehicle be parked anywhere but curbside, nor will the town's forces be used to assist in the loading of the truck, nor will the hours be expanded; said town vehicle will leave the location promptly at 11:00 a.m. on Saturday.
C. 
Any person failing to pay the fees required under this section, or in any other way violating the provisions hereof shall, upon conviction thereof, be punished by a fine not to exceed $500 or by imprisonment for a term not to exceed 90 days, or both, at the discretion of the Municipal Court Judge.
