[HISTORY: Adopted by the Mayor and Council of the Town of
Secaucus 8-26-75. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the
meanings indicated:
PARK
Any public park, open space, playground or other place used
for active or passive recreational use, situated within the Town of
Secaucus, which is opened to the public and under town jurisdiction.
No person shall vandalize, deface, displace, remove, destroy
or tamper with any structure, roadway, equipment or property of any
nature or kind located in or about any park.
No person shall destroy, cut, injure or remove any vegetation,
tree, plant or other natural growth, nor shall any person take, dig,
remove or carry away any plant, earth, stone or other material, except
upon proper authorization of the governing body.

No person shall climb any tree or walk, stand or sit upon monuments,
planters, fountains, railings, fences or upon any other property not
designated or customarily used for such purpose.
No person shall grill food without a permit issued pursuant to Section
97-17.
No person shall hunt, molest, harm or in any manner disturb
or annoy any animal, fish, wildlife or bird which may be found in
any park.
No person shall throw, discharge or otherwise place or cause
to be placed in the waters of any fountain, stream or other body of
water in or adjacent to any park or any tributary, stream, storm sewer
or drain flowing into such water any substance, matter or thing, liquid
or solid.
No person shall dump, deposit or leave any bottles, ashes, paper,
dirt, rubbish or any other form of refuse or trash in any park. No
such refuse or trash shall be left anywhere on grounds thereof, but
shall be placed in the proper receptacles.
A. No person shall operate a vehicle in any park at a rate of speed
in excess of 10 miles per hour and only on roadways designated for
such use.
B. Vehicles shall be parked only in established parking areas and in accordance with any posted directions; provided, however, that vehicles shall not be permitted to park within Schmidt's Woods Park, except in connection with an event for which a permit has been issued pursuant to §
97-17 herein.

C. No unauthorized vehicles shall be permitted in any park during the hours such park is closed as specified in §
97-19.
D. No unlicensed vehicle shall be permitted in any park.
No person shall swim, bathe or wade in any waters in or adjacent
to any park, except in such waters and at such places as are provided
therefor and in compliance with such regulations as may be effective
or hereinafter adopted.
A. No person shall carry or possess firearms of any description, air
rifles, spring guns, slings or other forms of weapons potentially
hazardous or dangerous to wildlife or human safety in any park, except
as specified below.
Bow and arrows shall not be permitted to be carried in a park,
except in areas specifically designated for the sport of archery or
to or from said designated area, and only by a person who has obtained
a permit for use of the range area from the Town of Secaucus. Bows
and arrows shall be transported and carried unloaded and contained
in a closed and fastened case, and in compliance with any and all
state regulations for their transportation and carrying.

B. No person shall kindle or build a fire, except in fire-places, outdoor
cooking grills or similar devices expressly provided or designed for
that purpose.
No person shall sell or offer for sale any object or merchandise, or solicit alms or contributions for any purpose, whether public or private, in a park unless a permit therefor shall have been issued by the Recreation Department, pursuant to §
97-17 herein.
No person shall play or take part in any game involving thrown
or otherwise propelled objects such as balls, arrows, javelins or
horseshoes, except in those areas set apart for such forms of recreation.
No person shall post, place or put any bill, sign, notice, placard
or other encumbrance on any tree, fountain, fence, post or other structure
in any park, unless authorization is obtained from the Recreation
Department.

No person shall consume or bring alcoholic beverages into any
park within the Town of Secaucus.
Indecent exposure, disorderly conduct, excessive noise, riot,
breach of the peace and the use of profane language is expressly forbidden
in all parks and playgrounds of the town.
No picnics may be held upon or in any park except in those sections
set apart for that purpose. No refreshments of any kind shall be sold
or offered to sale in connection with a picnic or other event, except
as authorized by permit.
A. No picnics, parades, processions, exercises or other activities which
are intended to attract in excess of six people shall be permitted
within any park unless a permit shall have been first obtained from
the Recreation Department.

B. A person seeking issuance of a permit hereunder shall submit an application
to the Recreation Department stating:
(1) The name and address of the applicant.
(2) The name and address of the person(s), corporation or association
sponsoring the activity.
(3) The day and hours for which the permit is desired.
(4) The park or portion thereof for which the permit is desired.
(5) Whether or not any food, beverage or other items will be offered
for sale.
(6) Any other information which the Recreation Department shall deem
reasonably necessary for the issuance of a permit.
C. Standards for the issuance of a permit by the Recreation Department
shall include the following:
(1) That the proposed activity or use will not unreasonably interfere
with or detract from the general enjoyment of the park.
(2) That the proposed activity or use will not unreasonably interfere
with or detract from the promotion of public health, welfare or safety.
(3) That the proposed activity or uses that are anticipated will not
promote violence, crime or disorderly conduct.
D. Within five days after the receipt of an application the Recreation
Department shall advise the applicant of its decision. If a permit
is denied, the Recreation Department shall specify in writing the
reasons for the denial, and an aggrieved person shall have the right
to appeal to the governing body within 10 days of such denial.
E. A permittee shall be bound by all park rules and regulations and
all applicable ordinances fully as though the same were recited in
said permit.
A. The person(s), corporation or association to whom a permit is issued
shall be liable for all loss, damage or injury sustained by any person
whatever by reason of negligence of the party to whom such permit
shall have been issued. The Town of Secaucus shall be held harmless
from any damages which may be incurred resulting from the negligent
act or omission of the permit holder.
B. The Recreation Department shall have the authority to revoke a permit
upon a finding of a violation of any law, ordinance or regulation,
or upon good cause shown.

No person shall remain, stay or loiter in any park, except as hereinafter provided, between the hours of 9:00 p.m. and 8:00 a.m., unless authorization is obtained pursuant to §
97-17 hereof. The prohibited hours of use for Buchmuller Park shall be 10:00 p.m. to 8:00 a.m. The prohibited hours for use of the Buchmuller Park Little League Field shall be 11:00 p.m. to 8:00 a.m. Any person found to be present during said hours shall be advised of said prohibition and given a reasonable amount of time to leave the park. Refusal to leave a park subsequent to the aforementioned warning shall constitute a violation of this chapter.

A. No person shall be permitted to enter or remain at the basketball
courts in Buchmuller Park, Secaucus, New Jersey, except residents
of the Town of Secaucus upon presenting proof of residency within
the Town of Secaucus.
Such proof of residency shall be shown upon demand to any Secaucus
Police Officer, Secaucus park/recreation attendant, or any member
or employee of the Secaucus Recreation Department.
For the purpose of this chapter, the following identification
proving residency shall be acceptable: Secaucus school or other school
identification card with photograph, identification card with photograph
issued by the Secaucus Youth Center, driver's license with photograph,
or in the event that such person does not have identification consistent
with the foregoing, any other two legal identifications, such as,
but not limited to, a driver's license without photograph, voter's
registration card, library card, etc.
The Secaucus Recreation Department may promulgate rules and
regulations to effectuate the foregoing, and the same shall be valid
upon resolution of the Mayor and Council of the Town of Secaucus approving
the same.
B. Any person who enters or remains at the basketball courts in Buchmuller
Park, Secaucus, New Jersey, except a resident of the Town of Secaucus
presenting proof of such residency within the Town of Secaucus, consistent
with the previous paragraphs, and who enters or remains at said location
contrary to actual communication to such person or contrary to the
signs excluding such person, shall be deemed to have committed a criminal
trespass in violation of N.J.S.A. 2C:18-3 and any amendments or supplements
thereto.

A. Residents
of the Town of Secaucus must register with the Environmental Department
on an application form approved by the Town Administrator or the Administrator's
designee in order to use a plot or take part in community garden activities
at one of the community garden locations. A seasonal fee shall be
established, and any fee schedule to obtain a community garden plot
shall be kept on file with the Town Clerk.
B. The Town
of Secaucus and the Environmental Department may promulgate rules
and regulations to effectuate the foregoing and for the safe use of
the community gardens. Same shall be valid upon filing said rules
and regulations with the Town Clerk.
C. Upon proper
registration and the provision of documentation in accordance with
the rules and regulations set forth by the Town of Secaucus and the
Environmental Department, a community garden plot will be assigned
to a participant for a specified gardening season, beginning on or
about May 15 through November 30. Community garden plots are limited
and will be assigned to a participant for a specified season at the
sole discretion of the Environmental Department.
D. It shall
be a violation to use a plot at a community garden except in conformity
with the previous subsections and in accordance with the rules and
regulations promulgated by the Town of Secaucus and the Environmental
Department. Enforcement shall be by the Town of Secaucus Police Department,
Environmental Department or their designee(s). Failure to comply with
the rules and regulations established for the use of the community
gardens may result in suspension or revocation of membership and/or
the issuance of a summons in accordance with this chapter.

A. Definitions.
COASTER
A footboard mounted upon two or more wheels and guided by
an upright steering handle. This device is propelled by the user in
an upright position and may be propelled by a small electric or combustion
engine.
CYCLES
A vehicle consisting of a tubular metal or composite tubular
frame mounted on a wheel or wheels and equipped with handlebars and/or
a saddle like seat; propelled by foot pedals or a small electric or
combustion engine.
ROLLER SKATES
A pair of shoes, mounted upon sets of wheels most often propelled
by the user in an upright, standing position or kneeling.
SKATEBOARDS
A footboard mounted upon four or more wheels propelled by
the user who sometimes stands, sits, kneels, or lays upon it while
it is in motion.
B. Use of cycles, skateboards, skates and coasters prohibited in designated
outdoor public areas. The use of cycles, skateboards, skates and coasters
is prohibited in the following areas:
(1) Buchmuller Park and all sidewalks, walkways, driveways and parking
areas bordering thereon.
C. Penalties. It is intended that this section will be codified as part of Chapter
97, Parks, of the Code of the Town Secaucus, and that a violation hereof will result in penalties as set forth in Section
97-20 of the Code of the Town of Secaucus.

Schmidt's Woods Park can be used only by Secaucus residents
or pool members.
A. No person shall be permitted to enter or remain at Schmidt's Wood
Park, Secaucus, New Jersey, except residents of the Town of Secaucus,
upon presenting proof of residency within the Town of Secaucus or
those with valid current pool memberships for the Town of Secaucus.
Such proof of residency shall be shown upon demand to any Secaucus
Police Officer, Secaucus park/recreation attendant, or any member
or employee of the Secaucus Recreation Department.
For the purpose of this chapter, the following identification
proving residency shall be acceptable: Secaucus school or other school

issued by the Secaucus Youth Center, driver's license with photograph,
or in the event that such person does not have identification consistent

B. Any person who enters or remains at the pool in Schmidt's Woods Park,
Secaucus, New Jersey, except a resident of the Town of Secaucus presenting
proof of such residency within the Town of Secaucus, consistent with
the previous paragraphs, and who enters or remains at said location
contrary to actual communication to such person or contrary to the
signs excluding such persons, shall be deemed to have committed a
criminal trespass in violation of N.J.S.A. 2C:18-3 and any amendments
or supplements thereto.

A. Residents of the Town of Secaucus must register with the Town Clerk
or the Department of Recreation on an application form approved by
the Town Administrator or Administrator's designee in order to use
or take part in archery activities at the Secaucus Archery Range.
Any fee schedule to obtain a permit for use of the Secaucus Archery
Range shall be kept on file with the Town Clerk.
B. The Town of Secaucus and the Secaucus Police Department may promulgate
rules and regulations to effectuate the foregoing and for the safe
use of the Secaucus Archery Range. Same shall be valid upon filing
said rules and regulations with the Town Clerk.
C. Upon proper registration and the provision of documentation in accordance
with the rules and regulations set forth by the Town of Secaucus and
the Secaucus Police Department, a permit will be issued to a participant
for the use of the Secaucus Archery Range.
D. Said permit shall be presented by a participant to any Secaucus Police
Officer, Secaucus park/recreation attendant or any member or employee
of the Town of Secaucus Recreation Department upon request while at
the Secaucus Archery Range.
E. It shall be a violation to use or remain at the Secaucus Archery
Range except in conformity with the previous paragraphs and in accordance
with the rules and regulations promulgated by the Town of Secaucus.

A. Adult offenders. Any person violating or failing to comply with any
of the provisions of this chapter shall, upon conviction thereof,
be punished by a fine of not less than $100 and not exceeding $1,000
or by imprisonment in the county jail for a period not to exceed 90
days, or both, as deemed appropriate by the Secaucus Municipal Court.
B. Juvenile offenders. Upon violation of any provisions of this chapter,
a juvenile shall be issued a verbal warning setting forth the nature
of the violation. Upon a second violation, the juvenile's parents
or guardian shall be notified of the violation by the Secaucus Police
Department. Upon the third or any subsequent violation of this chapter,
such juvenile shall be charged for having violated the same by the
Secaucus Police Department using a juvenile complaint form or similar
form, returnable in the Juvenile Court of Hudson County.
C. Notwithstanding any other provision of Section
97-20A and Section
97-20B, hereof, any person violating Section
97-19A Subsection
B or Section
97-19B. Subsection
B shall be subject to such penalties as authorized by the New Jersey Code of Criminal Justice, as the court of appropriate jurisdiction may impose.
