In accordance with N.J.S.A. 39:4-138(o), no person shall park a vehicle in any space on public or private property appropriately marked for vehicles for persons with disabilities, except such persons who have who have a current special vehicle identification card issued by the New Jersey Motor Vehicle Commission.

Parking in the below described locations or in other spaces designated as restricted parking for persons with disabilities in accordance with applicable statutory provisions and regulations without a current special vehicle identification card issued by the New Jersey Motor Vehicle Commission is prohibited within the Town of Secaucus.

No person, including persons who have been issued a special vehicle identification card by the New Jersey Motor Vehicle Commission, shall park a vehicle in the striped access aisle on public or private property adjacent to an appropriately marked parking spot designated for vehicles for persons with disabilities.

The following described locations are hereby designated as restricted parking zones limited for use only by persons who have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission.

Designated Handicapped Block 2: 1 space: located opposite space one on the westerly side of the middle parking aisle, the first space moving north to south approximately 118' feet off the north northwesterly side of the restaurant building, said space being 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 3: 2 spaces: located approximately 50' southwest of the southerly curbline between the restaurant building and theater building, said Block 3 being the first three spaces moving from north to south located on the westerly side of the 4th parking aisle moving from west to east, each space being 12' x 18' and marked as handicapped with appropriate signage.

Designated Handicapped Block 4: 3 spaces: located opposite Block 3 on the easterly side of the fourth parking aisle, said block of 3 spaces being 50' south of the southwesterly curb between the restaurant and theater buildings, each of the 3 spaces being 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 5: 3 spaces: first block of 3 spaces located 50' east of main entrance of the Embassy Suites Hotel, said spaces being 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 6: 3 spaces: located in the first parking aisle 50' from the east side of the Embassy Suites Hotel, said spaces being the 9th, 12th and 13th spaces moving from south to north. Each space is 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 7: 3 spaces: located approximately 25' of the west side of Ideal Toy, said block of spaces being the first three in the parking aisle adjacent to the building moving from south to north, each space being 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 8: 3 spaces: located in the first parking aisle 60' from the east side of the N.P.S. building, said spaces being the first one on the southwest side of the entrance drive, and the first two on the northeast side of the drive. Each space is 12' x 18' and marked as Handicapped with appropriate signage.

Parking Structure 'A' - Directly East of 400 Plaza Drive: Designated Handicapped Block 9: 5 spaces: located along the western edge of the grade level deck. The northernmost space abuts the northwest deck entrance drive. Each space is provided with the appropriate signage and pavement markings.

Designated Handicapped Block 10: 4 spaces: located opposite Block 9 being the first four spaces on the left side of the westernmost parking aisle moving from north to south. Each space is provided with the appropriate signage and pavement markings.

Parking Structure 'B' - Between the Embassy Suites Hotel and the Theater 8-Plex: Designated Handicapped Block 11: 2 spaces: located on the grade level, approximately 100' east of Stair #2 and abutting the theater's southern wall. Each space is provided with the appropriate signage and pavement markings.

Designated Handicapped Block 12: 2 spaces: located on the grade level, approximately 235' east of Stair #2 and abutting the theater's southern wall. Each space is provided with the appropriate signage and pavement markings.

The Mall at Mill Creek:

Designated Handicapped Block 1: 4 spaces: located 60' from the southern corner of the east side of the Foodtown Supermarket building, said block of spaces are the first four on the south side of the third parking aisle moving south from the northern most parking lot entrance road, each space is 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 2: 4 spaces: from the third entrance to the parking area moving from south to north on Mill Creek Drive, to the first parking aisle south of the entrance, the first 4 spaces on the north side of the parking aisle moving from west to east. Each space being 12' x 18' and marked as Handicapped with appropriate signage.

Designated Handicapped Block 3: 4 spaces: located approximately 60' from the northeast corner of the Caldor Department Store in the first parking aisle south of the second parking area entrance moving from south to north, said block of spaces being the first 4 on the northern side of the parking aisle moving from west to east. Each space is 12' x 18' and marked as Handicapped with appropriate signage.

Secaucus High School:

Beginning at a point 700 feet from the northwest corner of Mill Ridge Road and the High School entrance, and continuing west for a distance of 44 feet (2 spaces).

Restricted parking zones in front of or near residences of handicapped drivers. The Town of Secaucus shall, in accordance with the provisions of N.J.S.A. 39:4-197.6, establish restricted parking zones in front of or near residences occupied by handicapped drivers, provided that such parking is not otherwise prohibited and does not interfere with the normal flow of traffic. No restricted parking zones will be established for persons who do not transport themselves and who do not possess a New Jersey driver's license indicating handicapped status and a valid vehicle registration and vehicle license plates indicating handicapped status as issued by the State of New Jersey, Division of Motor Vehicles, pursuant to N.J.S.A. 39:4-205 and 4-206. However, those persons who do not transport themselves, but are parents or legal guardians of developmentally handicapped children residing on a full time basis within the same household and who would qualify under subsection B. of this section may be eligible, as established under N.J.S.A. 39:4-197.6 for such qualification. No restricted parking zones will be established for applicants who have a driveway, carport, garage or off street space available for their use. Circumstances will be considered concerning the ability of the handicapped person to effectively utilize the off street parking areas that are available.

The term "handicapped driver" applies to anyone as so defined pursuant to Title 39 of the New Jersey Statutes regarding qualifications for designation and issuance of proper identification by the Division of Motor Vehicles or other agency of the State of New Jersey.

Applications for the establishment of restricted parking zones may be obtained and shall be filed along with a copy of the handicap sticker or placard with the Town Clerk. An applicant shall submit proof of issuance of the appropriate license tags, windshield placard or other documentation to qualify for the establishment of such a parking space. The Town Clerk shall then forward all applications to the Handicapped Parking Inspector/Welfare Investigator or his designated agent who shall investigate each application for compliance with the applicable statutes, regulations and this section. After the Handicapped Parking Inspector/Welfare Investigator has made such a determination, he shall then submit the application back to the Town Clerk. The Town Clerk shall then forward it to the Mayor and Council for review and consideration.

Applicants who meet all of the requirements of the above subsections shall have their names and addresses submitted to the Mayor and Council for the approval of a restricted handicapped parking zone in front of or near their residence. The power of such approval is vested solely in the authority of the Mayor and Council acting through adoption of an ordinance to establish such a handicapped parking zone. If the Mayor and Council so approve, the Town shall establish a restricted parking zone in front of or near the residence of the applicant and shall issue a permit which complies with N.J.S.A. 39:4-197-7. Only the motor vehicle for which a valid permit has been issued shall be parked in such zone and only when the permit is properly displayed. The permit shall be utilized only by the vehicle with the license plate designated on the permit. Only one permit shall be issued to the applicant.

Applicants who do not meet all of the requirements of the above sections shall be notified of a denial of a restricted handicapped parking zone in front of or near their residence by mail. The initial processing fee will not be refunded until 10 days after the final determination of all appeals.

Restricted parking permits shall be valid for one year and shall be renewed thereafter in accordance with Subsections A through D. The year shall commence on January 1 and end on December 31. Any permits issued during the year shall continue until January 1 of that year, and shall be subject to renewal at that time. Licenses issued within three months before January 1 shall continue until the next January 1.

Any party denied a restricted parking zone shall have the opportunity to request consideration of such decision. A letter requesting reconsideration must be received by the Town Clerk within 20 days of the date of the notice of denial.

As a penalty for any fraudulent applicant, there will be a minimum $500 fine per conviction for a fraudulent application. In case a permit is granted under a fraudulent application, an additional $50 fine per day will be imposed on the holder of the fraudulently procured license.

Persons who have been issued permits prior to the effective date of this section shall apply for a permit pursuant to the requirements of this section by January 1 after the adoption of this section.

§ 127-58C Penalties.

Any person violating any provision of Article XIV, Restricted Parking Zones, shall be subject to the penalties as set forth in N.J.S.A. 39:4-197(3)c.

§ 127-58D Parking spaces for handicapped persons on private property.

Definitions. As used in this section:

(1)

HANDICAPPED PARKING — Any person who has lost the use of one or more limbs as a consequence of paralysis, amputation, or other permanent disability or who is permanently disabled as to be unable to ambulate without the aid of an assisting device or whose mobility is otherwise limited as certified by a physician with a plenary license to practice medicine and surgery or a podiatrist licensed to practice in this state or a bordering state;

(2)

ELIGIBLE HANDICAPPED PERSON — A handicapped person who is the holder of (1) an identification card issued by the New Jersey Motor Vehicle Commission pursuant to N.J.S.A. 39:4-205 or (2) a permit issued by a municipality under the authority granted by N.J.S.A. 39:4-197.7;

(3)

APPROPRIATE IDENTIFICATION — In the case of a restricted parking space, a placard or wheelchair symbol license plates issued by the New Jersey Motor Vehicle Commission pursuant to N.J.S.A. 39:4-206;

(4)

PARKED UNLAWFULLY — To park a motor vehicle in a restricted parking space if the motor vehicle does not display appropriate identification; and

(5)

RESTRICTED PARKING SPACE — A parking space which the local government has established for the exclusive use of a handicapped person.

Parking spaces for physically handicapped; guidelines. Parking spaces for the handicapped shall be constructed according to the following guidelines:

(1)

The spaces shall be provided in an area of the parking facility which is most accessible and approximate to the building which the facility serves;

(2)

Each parking space shall be marked with an R7-8 sign from the Manual of Uniform Traffic Control Device displaying the International Symbol of Accessibility, along with the following wording: "These spaces reserved for physically-handicapped drivers";

(a)

Beneath each R7-8 sign, each parking space shall also be marked with an R7-8P sign, as required by N.J.A.C. 5:23-7.1(b)(15), containing the following language:

"PENALTY $250 FIRST OFFENSE SUBSEQUENT OFFENSES $250 MINIMUM AND/OR UP TO 90 DAYS COMMUNITY SERVICE TOW-AWAY ZONE"

(b)

The bottom edge of the R7-8 sign shall be mounted approximately 60 inches above the parking lot surface.

(3)

Each parking space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or crutches to get in and out of either side of an automobile onto a level, paved surface suitable for wheeling and walking;

(4)

Where possible, such spaces shall be located so that handicapped persons are not compelled to wheel or walk behind parked cars; and

(5)

Where applicable, curb ramps or ramps shall be provided to permit handicapped persons access from the parking lot level to the servicing walkway. The ramp or curb ramp shall never be located where it would be blocked by a parked vehicle.

State identification card and certificate. No person shall park a motor vehicle in any parking space designated and marked as being set aside for the physically handicapped unless the operator of the vehicle is the holder of an identification card issued pursuant to N.J.S.A. 39:4-205, and the operator displays a placard on the motor vehicle. The placard is issued pursuant to N.J.S.A. 39:4-206 and it indicates that a handicapped person identification card has been issued to the person designated therein. Parking in a handicapped space without the aforementioned identification and placard shall create a presumption that the use of the space was not for a handicapped person.

Designation of handicapped spaces.

(1)

Plaza Diner located at 1262 Paterson Plank Road. Two handicapped parking spaces are designated as follows:

(a)

Starting at a point on the east side of the main entrance heading east for a distance of 12 feet; and

(b)

Starting at a point on the west side of the main entrance heading west for a distance of 12 feet.

(2)

Dunkin Donuts/Baskin Robbins at 1351 Paterson Plank Road, Secaucus, New Jersey. One handicapped parking space designated as follows:

(a)

Directly outside the main entrance of Dunkin Donuts/Baskin Robbins on the north end of the parking lot heading north for a distance of 12 feet and a length of 19 feet.

(3)

The parking area at Riverview Gardens Condominiums shall designate the following parking spaces as handicapped pursuant to this section. The spaces are designated as follows:

(a)

The parking space between parking spaces 6 & 7, 22 & 23, 28 & 29, 42 & 43, 54 & 55 and 115 & 116.

Violations. It shall be unlawful and a violation of the provisions of this section for any person to park a vehicle in a space designated for use by persons who have been issued special identification cards by the Division of Motor Vehicles pursuant to N.J.S.A. 39:4-205.

Enforcement. It shall be the duty of the Police Department of the Town of Secaucus to enforce the provisions of this section. Furthermore pursuant to N.J.S.A. 39:4-207.7, an eligible handicapped person may request a law enforcement officer to arrange for the removal and storage of a motor vehicle which is parked unlawfully in a parking space restricted for use by a handicapped person. It shall be the obligation of the owner of the motor vehicle to pay the reasonable costs for the removal and for any storage which may result from the removal.

Penalty. Any persons parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable for a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.

Exercise of police power. This entire section shall be deemed and construed to be an exercise of the police power of the Town of Secaucus in the State of New Jersey and all of its provisions shall be liberally construed with a view to the effectuation of such purpose.
