Chapter 127A of the Code of the Town of Secaucus shall hereby be known and designated as "Residential Parking."
It is the purpose and intent of this chapter to establish a residential parking program within the Town of Secaucus to alleviate the unfavorable parking conditions and other dangerous situations and conditions that have been created on residential streets and/or areas of the Town of Secaucus which have limited many residents from enjoying the residential character of their streets and neighborhoods and caused other unfavorable conditions, as more fully set forth in the Mayor and Council's statement set forth herein.[1]

Whenever any word or phrase is used in this chapter, the meaning respectively ascribed to them in Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such word or phrase. In addition, the following words and/or phrases shall have the meanings indicated herein:
HOLIDAY
Those days designated by Act of Congress or by the State Legislature or by the Town of Secaucus (by Resolution) as "holidays".
"PARKING FOR RESIDENTS ONLY" DESIGNATIONS
Areas designated wherein only motor vehicles, except exempt vehicles, displaying a valid permit or placard in the manner described herein, shall be exempt from the parking restrictions established pursuant to this chapter.
RESIDENTIAL PARKING STICKER OR PARKING PLACARD
An insignia issued by the Town of Secaucus to be used by a person to park on a street designated "Parking for Residents Only," in conformity with this chapter.
Except as may hereinafter be provided, no person shall park at any one location on any street designated "Parking for Residents Only" for a longer period of time than the time period authorized herein except residents whose motor vehicle displays a valid parking sticker or placard authorizing parking in such location, or persons exempt from this chapter.
The following areas are hereby declared to be "Parking for Residents Only" Zones and shall be known and designated as such, which areas may, from time to time, be amended, changed, or modified by ordinance of the governing body, as warranted:

No person shall park in any area designated "Parking for Residents Only" for longer than the period set forth in Section 127A-6 on Monday thru Fridays, 9:00 a.m. to 4:00 p.m., except holidays, except those whose motor vehicle displays a resident parking sticker or parking placard issued pursuant to this chapter or are otherwise exempt from such parking restrictions pursuant to this chapter.

A. 
Residential parking permits, visitor permits, business parking permits or other permits specified below shall be issued to persons for use for their motor vehicle(s) only upon written application to the Town Clerk or the Town Clerk's designee by such persons as follows:

(1) 
Resident vehicle. A legal resident who lives within an area designated as "Parking for Residents Only" who has a motor vehicle [registered] in his/her name and who has a motor vehicle for his/her use and under his/her control.
(2) 
Business Parking Permits.
A person who owns or leases a commercial property and engages actively in a business within an area designated "Parking for Residents Only," may apply for a Business Parking Permit for themselves and each employee thereof. However, no more than one parking permit may be issued for each such person or employee.
Such permit shall identify the address of the business, expiration date and other identifying information as deemed appropriate by the Town Administrator, the Police Chief and/or their designee. The permit shall allow the holder to park in designated parking areas during specified time periods as determined by the Town Administrator and/or the Police Chief, as set forth below. The permit shall allow the holder to park in designated parking areas during specified time periods without payment into a meter or paid parking station, if applicable for that designated area.
Each applicant for a Business Parking Permit will be required to complete a form authorized by the Town Administrator, the Police Chief and/or their designee and present documentation of identifying information, business address and vehicle. Applications will be available in the Town Clerk's Office. The permit shall be valid for a six-month period. The cost of a Business Parking Permit shall be $25.00 for each six-month period. The Town Clerk may refuse to issue a parking permit to any person or persons where the Town Clerk finds that the applicant has furnished false information on an application.
The permit is only valid within the designated areas set forth below, which may be amended or updated as needed, and may not be used to park in a "Parking for Residents Only" zone. Parking shall be on a first come basis subject to availability. The parking permit must be displayed properly on the vehicle in the location specified by the Town Administrator or Police Chief and/or their designee.

(3) 
Temporary visitor. A temporary visitor of a local resident or a temporary visitor of a person who owns or leases commercial property and actively engages in a business in an area designated "Parking for Residents Only" shall be issued a temporary placard for a period not to exceed 30 days each. A temporary placard shall include but not be limited to persons who shall stay at the home of a resident for an extended period, persons who perform personal and home services for a resident, professional persons (nurse, medical personnel, homemakers, servants, and maids), construction persons of the kind working on the premises, and the like. Such temporary visitors shall file their own application for a permit.
(4) 
Press vehicles. Residential parking permit placards shall be issued to media entities (press, magazines, networks, and the like) or persons employed by such businesses. For the issuance of such placards to individual persons, such applicants need only provide proof of employment by a newspaper, magazine, network, or the like, and the placards shall be issued to the business not the individual employee of the same; for issuance of such placards to such media businesses, the business applicant shall be issued only the number of placards reasonably necessary to meet its needs.
B. 
Applications for the issuance or reissuance of a residential parking permit sticker or placard pursuant to this chapter shall be made on forms signed under oath established by the Town Clerk or the Town Clerk's designee, which form shall require:
(1) 
Proof of residency or ownership or lease of property.
(2) 
Proof of motor vehicle ownership or vehicle use and control, if applicable.
(3) 
Statements by applicants verifying their entitlements hereunder, and such other information as may be required to verify the entitlement of the issuance of a sticker or placard.
C. 
It shall be unlawful and a violation of this chapter for a person to represent himself falsely hereunder as eligible for a residential parking permit sticker or residential parking placard, or to furnish false information on an application therefor. The Town Clerk shall refuse to issue a parking permit to any person or persons where the Town Clerk finds that the applicant has furnished false information on an application therefor.
A. 
The following vehicles are exempt from complying with this chapter:
(1) 
Emergency vehicles and government vehicles. Emergency vehicles (police, fire, ambulance, and other emergency vehicles licensed to a municipal, county, state or federal agency, or subdivisions thereof), and government vehicles registered to a municipality, county, state or federal government agency.
(2) 
Service vehicles of public utility companies. Public service, telephone, and other public utility vehicles may park within an area designated "Parking for Residents Only" during the time required to render service or repairs within the area.
Notwithstanding any provision herein, all persons are required to comply with all state and local traffic laws and regulations and parking restrictions; the exemption to park in any street designated "Parking for Residents Only" does not relieve any person from the other state and local traffic laws and parking restrictions that may otherwise exist or be established.
A. 
Vehicular stickers exempting vehicles from the parking restrictions herein provided shall be issued by the Town Clerk in the manner set forth by this chapter. Such residential parking permit sticker and/or residential parking placards shall include the following information:
(1) 
Permit number;
(2) 
Vehicle identification (license number, type of vehicle, etc.);
(3) 
Area in which vehicle may park lawfully, or other restrictions, if applicable;
(4) 
Type of permit;
(5) 
Expiration date, if applicable;
B. 
A placard shall be issued by the Town Clerk in lieu of a sticker for all types of visitors permit set forth in § 127A-8A(5).
C. 
Residential parking permit stickers authorizing such vehicles to be parked on a street designated "Parking for Residents Only" shall be displayed on a vehicle on the left rear window of the vehicle, except vehicles without rear windows wherein same shall be placed on the left/driver side rear window of the vehicle in such manner so that the sticker is visible to all passers-by, otherwise such vehicle shall be deemed parked unlawfully; resident, visitor, or temporary visitor parking placards shall be displayed hanging from the view mirror so that the placard is visible to all passersby, otherwise such vehicle shall be deemed parked unlawfully.
D. 
Residential parking permits are not transferable.
E. 
Residential parking permit stickers shall be used only for their intended purpose.
F. 
Except as may herein be provided, it shall be unlawful and a violation of this chapter for a person holding a valid residential parking permit sticker or residential parking placard issued pursuant thereto to authorize the use or display of such permit or placard on any motor vehicle other than that for which the permit was issued, or sell a motor vehicle without first removing the parking permit sticker or placard.
G. 
It shall be unlawful and a violation of this chapter for a person to copy, reproduce or otherwise bring into existence a facsimile or counterfeit residential parking permit sticker or residential parking placard. It shall further be unlawful and a violation of this chapter for a person to knowingly use a duplicate facsimile or counterfeit a residential parking permit sticker or residential parking placard in order to evade prohibitions or time limitations on parking regulations applicable to the Town of Secaucus residential parking program.
A. 
Each parking permit issued hereunder shall be valid until the date specified on the permit as long as the person issued such shall continue to qualify hereunder, and continue to own or have use of the vehicle set forth on such permit, as applicable.

B. 
Application procedures shall be established by the Town to effectuate the purpose of this chapter.
C. 
The Town of Secaucus shall issue each permit hereunder to all qualifying persons at the specified cost per permit type.

D. 
No sticker/placard shall be issued to any person or vehicle which has outstanding (unpaid) parking or motor vehicle tickets.
E. 
No person shall sell, transfer, assign, or otherwise set forth to any other person any sticker or placard issued to him.
F. 
Any person selling a car containing a sticker shall remove such sticker prior to the transfer of ownership.
A. 
The Town Clerk or the Town Clerk's designee shall issue a residential parking permit or placard, as applicable, or deny such request in writing, stating the reasons for such denial, within 10 days following receipt of an application containing all necessary information.
B. 
Any person who shall be denied a residential parking permit sticker or placard may appeal such denial decision to the Mayor and Council by filing a written statement of appeal, stating the basis for such appeal, the relief requested, and annexing thereto a copy of the denial. The Mayor and Council or their designee shall conduct a hearing respecting the same, wherein they may confirm, deny, or modify the decision of the Town Clerk or the Town Clerk's designee, consistent with this chapter, within 20 days of such hearing.
A. 
The Town of Secaucus shall issue a permit(s) to all qualifying persons at the specified cost per permit type.

B. 
In the event that a person loses a permit, such person shall be entitled to receive another by filing an appropriate statement with the Town Clerk's Office with respect to the same and paying a $3 fee per residential parking permit and a $20 fee per business parking permit.

C. 
In the event a sticker or placard become partially destroyed, a new sticker or placard shall be issued at no cost, provided that the person entitled to the same provides to the Town Clerk's Office the remaining portion of the sticker or placard that has been damaged.
A. 
For a period of 45 days after the adoption of this chapter, no summons imposing a penalty shall be issued to any person (or vehicle), for any violation hereof. During such period, warning notices only advising of the violation hereof may be placed on the vehicle indicating a violation of this chapter.
B. 
The Mayor and Council, upon adoption of a resolution setting forth the reasons therefor, or the Secaucus Chief of Police upon declaration of showing an adequate basis therefor, may suspend any provision or provisions hereof.

Unless another penalty is expressly provided in § 127-5A, any person violating or failing to comply with any provision of this chapter shall, upon conviction, thereof, be punished by a fine not exceeding $1,000, as deemed appropriate by the Secaucus Municipal Court. The continuation of such violation for each successive day shall constitute a separate offense.
