A. 
Manufacture, buying or selling of alcoholic beverages. The manufacture, buying or selling or keeping for sale as a beverage of any spirituous malt, intoxicating or vinous liquors or any preparation or substance in the nature thereof, or an alcoholic beverage as defined in N.J.S.A. 33-1.1 et seq., be and the same hereby is wholly prohibited.
B. 
Possession and consumption prohibited in certain public places. No person shall possess and/or consume in an open bottle, open can, glass, cup or other open container any beer, wine or other alcoholic beverage on the public streets, on the sidewalks, on the beach, on the boardwalk, in the public parks or in any other public place, including but not limited to, any automobile, bicycle or any other vehicle which is traveling, stopped or parked on any public street or in any other public place within the Borough.
C. 
No person shall have in possession or control any beverage containing alcohol or powdered alcohol while on or within any beach or any designated park area within the Borough of Wildwood Crest.

D. 
The prohibitions of Subsections B and C of this section shall not apply to any individual 21 years of age or older attending any special event which has been approved by the Board of Commissioners pursuant to the provisions of Chapter 40, Article VI, Special Events and Use of Municipal Facilities and Grounds of the Code of the Borough of Wildwood Crest wherein the resolution of the Commissioners approving the special event permits the consumption, carrying or possession of alcoholic beverages in opened containers during designated hours and in designated locations. Such suspension of the prohibitions herein shall be limited to the time and places and subject to the conditions stated in the resolution approving the special event. Nothing in this section shall be deemed to supersede the provisions of N.J.S.A. 39:4-51a, N.J.S.A. 39:4-51b or any other statute of the State of New Jersey.

Any person or persons who permit, take part in or assist in any violation of this Article I shall, upon conviction for each and every violation thereof, be subject to a penalty of not more than $2,000, and/or or to imprisonment for a period not exceeding 90 days, and/or a period of community service not to exceed 90 days, in the discretion of the Municipal Court Judge before whom each conviction shall be had. Any repetition of any act herein prohibited shall be deemed a new and separate offense, and upon conviction thereof be subject to the penalties herein.
Enforcement of this ordinance is reposed in and shall be the duty of the Police Department of the Borough of Wildwood Crest.
