A. 
No permit for moving or certificate of occupancy shall be issued for any building, structure, accessory building, garage, tool shed or bathhouse to be erected upon any lot, if such building, structure, accessory building, garage, tool shed or bathhouse is presently in existence and is to be moved from any other municipality or jurisdiction into the Borough of Wildwood Crest.
B. 
No building or structure as aforesaid shall be moved from one location to another within the limits of the Borough of Wildwood Crest unless the same conforms to all requirements for building, electrical, mechanical and plumbing under the Uniform Construction Code, where applicable, and all other borough ordinances, including the Borough Land Development Ordinance codified as Chapter 85, and the amendments thereto and supplements thereof.
C. 
No permit for moving or certificate of occupancy shall be issued for any building or other structure as hereinabove set forth if such building is to be moved within the Borough of Wildwood Crest from a zone with lesser requirements and restrictions to a zone with greater requirements and restrictions. All buildings considered for relocation shall meet the current zoning requirements as stated in Chapter 85, Land Development Ordinance.

Before any permit or certificate of occupancy is issued by the Construction Official for the moving or removal of any building or structure, as aforesaid, the application for said permit must be certified to by the Construction Subcode Officials for building, plumbing, electrical and mechanical, where applicable, as to compliance with the ordinances of the Borough of Wildwood Crest, in the County of Cape May, as aforesaid, as it relates to the particular departments of said officials. In addition thereto, the application for moving or removal of any building or structure within the boundaries of said borough must be approved by the Zoning Officer indicating that the said building or structure meets all requirements as to conformity with the Borough Mechanical, Zoning and Land Development Ordinance, as aforesaid, and in all other respects structurally conforms to the use or uses permitted by the provisions of the zoning regulations covering the location within the borough of the lot or lots upon which said building or structure is to be moved and relocated.
If any section, part of a section, sentence, clause or phrase of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions thereof shall nevertheless remain in full force and effect.
This ordinance shall take effect upon final passage and advertisement according to law.

No permit shall be issued for the use for moving purposes of any street, alley, avenue or public passageway from the 15th of May and through the 15th of September every year, unless upon special request and permission of the Board of Commissioners.[1]
