It shall be unlawful for any person to display, exhibit, offer for sale or sell any newspaper on any street, sidewalk or other public place within the borough, except in accordance with the provisions of this ordinance.
The Code Enforcement Officer shall be responsible for enforcement of Chapter 42A.
As used in this ordinance, the following term shall have the meaning indicated:
NEWSPAPER RACK
Racks or holders for the exhibition, display and sale of newspapers without any vendor being present at the time of sale.
There shall be no more than two newspaper racks on any corner of intersecting streets. The racks shall not obstruct any crosswalk, impede emergency vehicle access to fire hydrants, impede visibility by any motor vehicle or cause congestion.
A. 
No newspaper rack shall be installed or maintained on any street, sidewalk or public place within the borough without a mercantile license therefor, specifying the exact location of said rack.
B. 
Any rack so maintained after the effective date of this ordinance may be impounded by the borough and the owner subject to a storage charge of $5 per day.
C. 
In the event of more than two applications for licenses for any one corner, the license shall be issued on the basis of the order when received.

Upon the conviction of a violation of any section of this ordinance, the owner shall be subject to a fine not to exceed $2,000, or imprisonment for a period not to exceed 90 days, or community service for a period not to exceed 90 days. Each day that the violation continues may be deemed a separate offense.
This ordinance shall take effect in the time and manner as prescribed by law.
