For the purpose of this ordinance and in the interpretation and application hereof, except as the context may otherwise require, the following terms shall have the meanings indicated:
COMPENSATION
An employee's average annual compensation during the last year of his full-time permanent employment with the Borough of Wildwood Crest prior to the employee's retirement date.
DAILY RATE
Compensation, as herein defined, divided by the number of working days in the particular employee's last year of full-time permanent employment. The number of working days for this purpose shall be based on a five-day workweek and shall not take into account any holiday, vacation or other leave time to which the employee is entitled.
EFFECTIVE RETIREMENT DATE
The date on which an employee ceases to be a full-time, permanent employee, either as a result of cessation of employment while living or by reason of death.
FULL-TIME PERMANENT EMPLOYMENT
Any assignment to any position of employment with the Borough of Wildwood Crest for an indeterminate period as defined by the New Jersey Department of Civil Service.
LONGEVITY FACTOR
That percentage based upon the employee's length of full-time permanent employment with the Borough of Wildwood Crest which shall be utilized to determine benefits as provided herein. Any employee in his final year of employment who worked more than six months shall be credited with a full year for the purpose of computing the number of years of service. Unless provided in bargained union agreements, longevity provisions shall not apply to any employees hired on or after January 1, 1995.

UNUSED SICK LEAVE
The number of days of accumulated sick leave accrued during the employee's full-time permanent employment with the Borough of Wildwood Crest which is credited to an employee on the employee's effective retirement date.
Each and every full-time permanent employee of the Borough of Wildwood Crest shall be entitled at the time of retirement to receive supplemental compensation for unused accumulated sick leave credited to him on the effective date of his retirement.
Except as otherwise noted herein, each retiring employee shall receive a supplemental retirement benefit for unused sick leave which shall be determined by multiplying the number of days of unused sick leave by the daily rate and then multiplying that result by the longevity factor. Unless provided in bargained union agreements, longevity provisions shall not apply to any employees hired on or after January 1, 1995. Effective January 1, 2015, the amount of longevity pay that an employee is entitled to is frozen at the longevity pay which the employee is receiving as of December 31, 2014. No further increase shall be made either by additional years of service or an increase in pay. The longevity pay is frozen at the dollar amount in effect as of December 31, 2014.
A. 
For employees hired prior to January 1, 2015, the supplemental retirement benefit as provided for herein shall not exceed the sum of $15,000.
B. 
For employees hired on or after January 1, 2015, the supplemental retirement benefit as provided for herein shall not exceed the sum of $7,500.
Upon application by a retiring employee, at least 60 days prior to retirement in the case of a retiring employee who is ceasing employment, or within 60 days after death in the case of a retiring employee who qualifies under this ordinance by reason of death while a full-time permanent employee of the Borough of Wildwood Crest, the appointing authority shall certify the amount of unused sick leave. In the sole option of the Board of Commissioners, the payment on account therefor may be made in either of two methods: in three equal, annual installments commencing on the first day of July of the year following the year of the employee's effective retirement date or by one payment in full on or before the first day of July of the year following the year of the employee's effective retirement date. In the event of the death of the employee subsequent to the effective retirement date but prior to payment of said supplemental retirement benefit or any or all of the installments thereof or in the event of qualification under this ordinance by reason of death while a full-time, permanent employee of the Borough of Wildwood Crest, the payment, installment or installments falling due after the death of the employee will be made to the executor, administrator, legatee or next of kin, as determined in the sole discretion of the Borough of Wildwood Crest upon submission of proper proof of entitlement by that person making a claim therefor, and any such decision by the Borough of Wildwood Crest and payment pursuant thereto shall be final and conclusive as to all persons and shall discharge the Borough of Wildwood Crest, to the extent of such payment, from any further liability to any other person with respect thereto.
A. 
Pursuant to N.J.S.A. 40A:10-23 and the Borough's Chapter 48 Resolution as filed with the New Jersey Division of Pensions and Benefits, employees hired on or before December 31, 2009 who retire with 25 years of service to the Borough or those with 15 years of service and who are at least 62 years of age or have been placed on approved disability retirement may continue to receive paid health insurance coverage. However, contribution from the employee may be required in accordance with statute. No employees hired on or after January 1, 2010 shall be eligible for post-retirement health insurance benefits until they have completed 25 years of service with the Borough of Wildwood Crest or in the event of an approved disability retirement and provided said employee meets all other applicable pension retirement criteria required in order to qualify for post-retirement health insurance benefits. Effective January 1, 2010, all employees hired on or before December 31, 2009 and retirees shall pay a cost contribution in accordance with P.L. 2011, Chapter 78, and all applicable amendments thereto. Effective January 1, 2015, the Borough shall not pay for any post-retirement health benefits for any employees on or after January 1, 2015. Effective January 1, 2015, any employee who retires from the Borough of Wildwood Crest and is eligible for post-retirement benefits and who, after retirement from the Borough, secures employment with any local, County, State or Federal agency or entity including, but not limited to, law enforcement entities where, by virtue of their employment, New Jersey State health benefits plan is offered or who is otherwise eligible to receive health insurance coverage through their employment shall be required to accept coverage for health insurance as offered through their current employer and shall cease to be covered for health insurance by the Borough of Wildwood Crest. Retirees receiving health benefits must enroll in Medicare when eligible and shall be reimbursed by the Borough on an annual basis upon proof of payment for the standard Medicare Part B premium paid by said retiree.

Self-Insurance Fund.

(a) 
A Self-Insurance Fund for the purpose of providing retiree life insurance for covered retirees currently covered prior to January 1, 2016 and additional retirees as may be contractually required is hereby established.
(b) 
The Basic Plan amount is $15,000 and the Maximum Plan amount is $15,000.
(c) 
The following age reduction formula will be used in administering this plan, unless otherwise changed by formal action of the Commissioners of the Borough of Wildwood Crest.

50% at Age 70
65% at Age 75
(d) 
There will be no employee contribution.
(e) 
Coverage will be provided for the life of the retiree in accordance with the provisions above and may require future exclusions, limitation, terms and conditions in order to keep the program in force by the Borough of Wildwood Crest.
B. 
Health insurance waiver incentive program. A health insurance waiver incentive program is hereby established in accordance with the provisions of N.J.S.A. 40A:10-17.1 for all eligible officers and employees of the Borough of Wildwood Crest and the program shall be as stated in the current Borough Policy and Procedures Manual on file with the Municipal Clerk. The decision of the municipality to allow its employees to waive coverage and the amount of consideration to be paid therefor shall not be subject to the collective bargaining process.

C. 
Dental benefits. The dental benefits shall be as stated in the current Borough Policy and Procedures Manual on file with the Municipal Clerk.
D. 
Vision. The eyeglass or vision benefits shall be as stated in the current Borough Policy and Procedures Manual on file with the Municipal Clerk.
E. 
Effective January 1, 2011, only employees working the equivalent of a "full-time" work week for that particular departmental operation, on a regular and recurring basis, shall be entitled to health insurance coverage. This provision shall not apply to any officials, officers, or employees who are currently qualified to receive health insurance coverage as of the effective date of this ordinance.

Retirees receiving retiree health benefits who are duly enrolled in Medicare Parts A and B shall be reimbursed by the Borough of Wildwood Crest. The program shall be as stated in the current Borough Policy and Procedures Manual on file with the Municipal Clerk.
All other ordinances in conflict or inconsistent with this ordinance are hereby repealed to the extent of such conflict or inconsistency.
Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, it is the intent of the municipality that it would have passed all other portions of the ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
This ordinance shall take effect upon final passage and advertisement thereof as required by law.
