[HISTORY: Adopted by the Mayor and Council of the Borough of Neptune City 10-28-1974 by Ord. No. 74-6. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
DRIVER
Any person who drives a taxicab within this borough.
OPERATION
Of a taxicab, shall consist of transporting in such taxicab one or more persons for hire. Accepting a passenger to be transported for hire from a point of departure within the borough to a destination within or without the borough shall be deemed to be "operation" of a taxicab within the borough. The operation of a taxicab in any of the above-described manners by one other than the owner shall be deemed operation by the owner thereof, as well as by the person actually driving the same. The transportation of any person other than the owner or driver in any motor vehicle bearing a sign therein or thereon using the words "taxi," "taxicab," "cab" or "hack" shall be prima facie evidence of operation.
OWNER
Any person, corporation or association in whose name title to any taxicab is registered with the New Jersey Department of Motor Vehicles, or who appears in such records to be the conditional vendee or lessee thereof.
TAXICAB
Includes any automobile or motor car, commonly called "taxi," engaged in the business of carrying passengers for hire which is held out, announced or advertised to be operated or run, or which is operated or run, over any of the streets within the Borough of Neptune City and which accepts passengers for transportation from points or places to points or places within or without the said borough.
TAXICAB STAND
A section of a public street or public place set apart for the exclusive use of a limited number of taxicabs, when such section is distinctly marked as such by a metal sign attached to a stanchion on the curb or other conspicuous place or by clearly visible marks upon the surface of the street or public place.
No person shall hire out, keep or use for hire or pay, or cause to be kept or used for hire or pay, any taxicab whose point of origin, base of operation or office is located in the Borough of Neptune City, unless both the taxicab and the driver thereof are licensed pursuant to this chapter.
There are hereby established two classes of taxicab licenses in the Borough of Neptune City as follows:
A. 
Taxicab driver's license. This license shall entitle the person named therein to operate within this borough any taxicab duly licensed hereunder.
B. 
Taxicab owner's license. This license shall entitle the taxicab therein described to be operated in this borough by a driver duly licensed hereunder.
A. 
The number of licenses to be issued shall be as follows:
(1) 
Taxicab drivers' licenses. The number of taxicab drivers' licenses under this chapter to be issued and outstanding in any one year shall be unlimited.
(2) 
Taxicab owners' licenses. The number of taxicab owners' licenses under this chapter to be issued and outstanding in any one year shall not exceed six No person shall hold or control more than two taxicab owners' licenses at any one time.
B. 
Every owner receiving a taxicab owner's license under this chapter shall operate said licensed taxicab continuously throughout the year for which said license is granted.
Any license issued pursuant to the terms of this chapter shall expire at 12:00 midnight of the 31st day of December of the year in which it was issued, and shall not be transferable.
A. 
Application form. Each applicant for the issuance or renewal of a license of either class shall supply in full the information requested on application forms adopted by the Mayor and Council and obtained from the Borough Clerk, and shall verify the correctness thereof by his oath or affirmation. He shall file the completed application with the Borough Clerk, together with the full amount of the proper fee hereinafter fixed.
B. 
Applications for taxicab owners' licenses.
(1) 
Applications for taxicab owners' licenses shall be filed with the Borough Clerk at any time, but no taxicab shall be operated in the Borough of Neptune City until properly licensed for each particular year.
(2) 
No vehicle covered by the terms of this chapter shall be licensed until it has been thoroughly and carefully inspected and examined by an officer designated by the Mayor and Council and found to be in a thoroughly safe condition for the transportation of passengers.
(3) 
Each applicant for a taxicab owner's license shall, together with his application, submit the insurance policy or certificate in lieu thereof, as required by N.J.S.A. 48:16-3, covering the taxicab sought to be licensed.
C. 
Applications for taxicab drivers' licenses.
(1) 
Applications for taxicab drivers' licenses may be made at any time, but no one shall drive or operate a taxicab in the Borough of Neptune City until a proper license for each particular year has been issued.
(2) 
Each applicant for a taxicab driver's license shall conform to the following regulations:
(a) 
He shall be of the age of 21 years or over to allow for more maturity and more driving experience.
(b) 
He shall present the certificate of a reputable physician showing that he has been examined within 60 days and that he is of sound physique with good eyesight and not subject to epilepsy, vertigo, heart trouble or other infirmity of body or mind which might render him unfit for the safe operation of a taxicab.
(c) 
He shall not have been convicted of a crime and shall not have violated any provision of this chapter.
(d) 
He shall not be addicted to the use of narcotics or intoxicating liquors.
(e) 
He shall produce affidavits of his good character from at least two reputable citizens who have known him personally, and shall produce a further affidavit from his last employer, unless in the estimation of the Mayor and Council sufficient reason is given for its omission.
(f) 
He shall fill out upon an application form provided by the Borough Clerk his full name, residence, places of residence for the preceding five years, age, height, color of eyes and hair, place of birth, previous employment, whether married or single, whether he has ever been convicted of a crime or violation of this chapter and whether his license has ever been revoked, and for what cause, which statement shall be signed and sworn to by the applicant and filed with the Borough Clerk as permanent record. He shall also furnish four copies of photographs, size two by two inches, front view.
(g) 
He must be fingerprinted, and said prints must be placed on file in police headquarters.
A. 
Upon notification by the Borough Clerk of satisfactory fulfillment of the foregoing requirements and regulations, the Mayor and Council shall either grant or deny the application, unless it decides to hold the same over for further investigation.
B. 
Each applicant granted a license under this chapter shall be issued a license card in evidence thereof in a form approved by the Mayor and Council and signed by the Borough Clerk in behalf of said Council.
A. 
The annual fee for each taxicab owner's license hereafter issued or any renewal thereof shall be $75 for each year or portion of a year for which the license is issued or renewed.
B. 
The annual fee for each taxicab driver's license hereafter issued or any renewal thereof shall be $25 for each year or portion of a year for which the license is issued or renewed.
C. 
No fees shall be prorated nor any part thereof refunded for any reason except that upon the denial of an application for the issuance or renewal of a license by the Mayor and Council, 90% of the fee deposited shall be returned to the applicant and 10% shall be retained by the borough as compensation for investigation of the application.
A. 
The license card issued to a taxicab driver upon granting of his license shall have affixed to it one of the four photographs required to be filed with the license application, as provided in § 119-6C(2)(f).
B. 
Such license card shall at all times be prominently displayed and adequately protected in the interior of any taxicab operated by the licensee so that the face thereof shall be at all times in full view of and plainly legible to any passenger seated on the rear seat of such taxicab. The said license card shall at all times be and remain the property of the borough and on direction of the Mayor and Council shall at once be surrendered to the Borough Clerk.
C. 
No taxicab driver's license card other than that of the licensee actually operating the cab at the time shall be displayed therein.
No taxicab shall hereafter be operated in this borough unless and until there is prominently displayed in the interior thereof, within the full view and access of any passengers therein, a complete list of fares, charges or tariff rates charged for transportation of passengers, which fares, charges or tariff rates so displayed, and no others, shall be those to be charged any passenger so transported.
A. 
Every licensed taxicab shall have affixed or painted on both sides thereof the words "taxi" or "cab" in letters at least six inches high, or the name of the operating owner, containing the words "taxi" or "cab" or "taxicab."
B. 
Every licensed taxicab shall have affixed or painted on each side thereof in letters at least one inch high the name of the owner thereof, followed or preceded by the word "owner."
C. 
Every licensed taxicab shall have a decal, provided by the Borough Clerk, affixed to the lower right-hand corner of the rear window in full view.
The rate of fare to be charged within the borough limits shall not exceed $0.75 for one passenger for a trip from one place to another within the borough. Two or more passengers going to the same destination from the same place of origin (both within the borough) shall be charged $0.50 for each passenger. If several passengers are proceeding to several different destinations within the borough, the charge for each passenger shall be $0.75 to each different destination.
A. 
No person shall park any taxicab on any of the streets of the Borough of Neptune City at any time, except at such place or places as the Mayor and Council may from time to time designate as municipal taxicab stands, and said taxicab stands shall provide twenty-four-hour service.
B. 
No taxicab shall be parked and left unattended.
C. 
No taxicab shall be operated from a residence or other building located in a residential zone, and when a taxicab is parked at the owner's or operator's place of residence, it shall be out of service and shall have a sign so stating conspicuously displayed on the vehicle.
Immediately after the termination of any hiring or employment, every driver of a taxicab must carefully search such taxicab for any property lost or left therein, and any such property discovered must be reported in writing to the Police Department, with brief particulars and a description of such property, within 24 hours after the finding thereof, unless sooner claimed or delivered to the owner.
A. 
The Mayor and Council of the Borough of Neptune City may, in its discretion, refuse to issue or renew or may, after notice and hearing, revoke or suspend any license issued hereunder if the applicant or licensee:
(1) 
Has been convicted of a crime in this or any other jurisdiction.
(2) 
Has been convicted of being a disorderly person.
(3) 
Has been found guilty of a violation of Title 39. Motor Vehicles and Traffic Regulations, of the New Jersey Statutes Annotated.
(4) 
Violates any provision of this chapter or any ordinance of the Borough of Neptune City.
(5) 
Has any unsatisfied judgment of record against him arising out of an automobile accident.
(6) 
Is an alien citizen of any nation between which and the United States of America a state of war exists.
(7) 
Failed or fails to render reasonably prompt, safe and adequate taxicab service.
(8) 
Has in any degree contributed to any injury to any person or damage to property arising out of negligent operation of a motor vehicle.
(9) 
Has any communicable or contagious disease, or has developed any physical or mental condition which interferes with his ability to operate a motor vehicle in a safe manner.
(10) 
Has not complied fully with all requirements of this chapter.
B. 
Any taxicab owner's license may be denied, revoked or suspended, or not renewed, for any of the following reasons:
(1) 
If the motor vehicle licensed or to be licensed, by reason of unsafe or unsanitary conditions, is dangerous to the safety or health of the occupants or others.
(2) 
If the policy of insurance required by N.J.S.A. 48:16-3 has once lapsed or such coverage is not maintained at all times.
