As used in this chapter, the following terms shall have the
meanings indicated:
DRIVER
Any person who drives a taxicab within this borough.
OPERATION
Of a taxicab, shall consist of transporting in such taxicab
one or more persons for hire. Accepting a passenger to be transported
for hire from a point of departure within the borough to a destination
within or without the borough shall be deemed to be "operation" of
a taxicab within the borough. The operation of a taxicab in any of
the above-described manners by one other than the owner shall be deemed
operation by the owner thereof, as well as by the person actually
driving the same. The transportation of any person other than the
owner or driver in any motor vehicle bearing a sign therein or thereon
using the words "taxi," "taxicab," "cab" or "hack" shall be prima
facie evidence of operation.
OWNER
Any person, corporation or association in whose name title
to any taxicab is registered with the New Jersey Department of Motor
Vehicles, or who appears in such records to be the conditional vendee
or lessee thereof.
TAXICAB
Includes any automobile or motor car, commonly called "taxi,"
engaged in the business of carrying passengers for hire which is held
out, announced or advertised to be operated or run, or which is operated
or run, over any of the streets within the Borough of Neptune City
and which accepts passengers for transportation from points or places
to points or places within or without the said borough.
TAXICAB STAND
A section of a public street or public place set apart for
the exclusive use of a limited number of taxicabs, when such section
is distinctly marked as such by a metal sign attached to a stanchion
on the curb or other conspicuous place or by clearly visible marks
upon the surface of the street or public place.
No person shall hire out, keep or use for hire or pay, or cause
to be kept or used for hire or pay, any taxicab whose point of origin,
base of operation or office is located in the Borough of Neptune City,
unless both the taxicab and the driver thereof are licensed pursuant
to this chapter.
There are hereby established two classes of taxicab licenses
in the Borough of Neptune City as follows:
A. Taxicab driver's license. This license shall entitle the person
named therein to operate within this borough any taxicab duly licensed
hereunder.
B. Taxicab owner's license. This license shall entitle the taxicab
therein described to be operated in this borough by a driver duly
licensed hereunder.
Any license issued pursuant to the terms of this chapter shall
expire at 12:00 midnight of the 31st day of December of the year in
which it was issued, and shall not be transferable.
No taxicab shall hereafter be operated in this borough unless
and until there is prominently displayed in the interior thereof,
within the full view and access of any passengers therein, a complete
list of fares, charges or tariff rates charged for transportation
of passengers, which fares, charges or tariff rates so displayed,
and no others, shall be those to be charged any passenger so transported.
The rate of fare to be charged within the borough limits shall
not exceed $0.75 for one passenger for a trip from one place to another
within the borough. Two or more passengers going to the same destination
from the same place of origin (both within the borough) shall be charged
$0.50 for each passenger. If several passengers are proceeding to
several different destinations within the borough, the charge for
each passenger shall be $0.75 to each different destination.
Immediately after the termination of any hiring or employment,
every driver of a taxicab must carefully search such taxicab for any
property lost or left therein, and any such property discovered must
be reported in writing to the Police Department, with brief particulars
and a description of such property, within 24 hours after the finding
thereof, unless sooner claimed or delivered to the owner.
