The following words, when used in this article, shall have the
meanings ascribed to them in this section, except where the context
clearly indicates otherwise:
GARBAGE
Any animal or vegetable waste, including offal, carcasses,
putrid meat, bone, fat, swill and vegetable or animal refuse resulting
from handling, preparation or consumption of food.
PERSON
Any person, partnership or corporation.
WASTE
Includes paper, ashes, shavings, rubbish, manure, stone,
wood, mortar, lime, sweepings, boxes, cartons, glass, garbage, or
any other substance of any kind generally discarded or disposed of.
On and after the effective date of this article, it will be
unlawful for any person to keep or suffer to remain on his premises
or on any private property owned, leased or controlled by him any
accumulation of garbage, waste, offal, vegetable or animal waste,
or to cast the same upon any lot or piece of ground within the limits
of the Township of Lower Windsor or on any highway, street, or alley,
or upon the shores or margins of any of the streams within said Township,
or so near to the limits thereof as to be offensive.

A. Any person who shall violate any provision of this article shall,
upon conviction thereof in a summary proceeding before a Magisterial
District Judge, be sentenced to pay a fine of not more than $1,000,
plus the costs of prosecution and, upon default of payment of said
fine and costs, to imprisonment in the York County Prison for not
more than 90 days. Each day or portion thereof in which a violation
is found to have been violated shall be a separate offense.

B. Enforcement. This article shall be enforced by the Lower Windsor
Township Police Department or by the other appropriate officer or
officers of Lower Windsor Township. Any such officer is authorized
to determine whether a violation of such article has occurred.
