A. 
Findings. The City of Greensburg recognizes that the duties of the Greensburg Volunteer Fire Department require the use of emergency rescue and response materials, hazardous abatement materials and fire-suppression tools, materials and equipment during its emergency responses. The City of Greensburg also recognizes that the costs of damaged or expended materials places an increasing financial burden on the Volunteer Fire Department.
B. 
Intent. This article is intended to confirm and/or grant the Volunteer Fire Department the authority to seek recovery of all reasonable costs of responding to such emergency incidents, as allowed by applicable law.
The Greensburg Volunteer Fire Department is authorized to recover costs from property owners and/or insurance carriers for the usual, reasonable, and customary costs of abatement, construction, stabilization and any other materials used, consumed and /or expended in response to any fire, safety, rescue, hazardous waste or emergency incident.
Nothing in this article shall authorize the Volunteer Fire Department or Department personnel to refuse or delay any rescue service to any person, firm, organization or corporation, due to the lack of insurance coverage or inability or refusal to pay for said rescue services.
If any part of this article is declared to be unconstitutional, illegal or invalid, the validity of the remaining provisions shall be unaffected thereby. It is the intention of the Council of the City of Greensburg that this article would have been adopted had such unconstitutional, illegal or invalid part not been included.
All ordinances inconsistent herewith be and the same are hereby repealed.
