As used in this article, the following terms shall have the meanings indicated:
SUMP PUMP
For the purposes of this article, a sump pump is defined as any device or method which discharges drainage resulting from rainwater, springs, wells, or other groundwater.
No sump pump, as defined in § 317-22, shall discharge drainage resulting from rainwater, springs, wells, or other groundwater into the sanitary sewer system, nor shall any sump pump be permitted to discharge so as to create a hazardous condition to the public.
A. 
Any person or entity who shall violate any of the provisions of this article or any order promulgated hereunder shall, after a summons is issued under the terms hereof, be punished as follows for each such violation occurring during any calendar day being considered a separate offense:
(1) 
For a first offense, by a fine not less than $500 nor more than $2,000.
(2) 
For a second offense, by a fine not less than $1,000 nor more than $2,000.
(3) 
For a third or any subsequent offense, by a fine not less than $1,500 nor more than $2,000.
B. 
The owner of any building, lot, or land where a violation of this article has occurred, as well as any contractor, agent, or person who commits or knowingly assists in the commission of any such violation, shall each be guilty of a separate offense, and, upon conviction, shall each be liable to the penalties specified in this section.
C. 
Any person violating any provision of this article shall become liable to the Borough for any expense, loss, or damage caused to the Borough because of such violation, in addition to all costs of collection and enforcement proceedings.
