No person shall cut down, trim, destroy, injure or otherwise
deface any tree on a Village property or right-of-way without permission
of the Village Board of Trustees.
A.
Any person may serve written notice upon the Clerk requesting the
removal of a Village tree and stating the reasons therefor. The Board,
after due deliberation, may cause the tree to be removed or cut down
or it may permit the abutting landowner to cut down the same; the
timber shall be offered to the abutting landowner. The Village shall
remove all unwanted timber and debris. No liability shall be incurred
by the Village by reason of its having permitted the landowner to
remove or cut down a tree(s).
B.
The Village has the right to remove trees within its right-of-way
that are dead or hazardous, obstructing views for traffic or pedestrian
movement, conflicting with utility work, and for any other cause that
the Village Board deems reasonable.
C.
Whenever a tree is removed from the public right-of-way, effort should
be made by the Village or entity responsible for directing the work
to replant trees near the removal site, if it is reasonable to do
so.
A.
Planting of vegetation of any kind by Village residents within any
right-of-way is permitted only with the prior approval of the Board
of Trustees. If permission is granted, all expenses involved in planting
of trees are to be borne by the applicant. In considering whether
to grant approval the following factors shall be considered:
(1)
The proposed location of such vegetation within the right-of-way.
(2)
The type of vegetation proposed to be planted. Any trees permitted
to be planted must be selected from a list of trees suitable for such
use. This list will be maintained and updated by the Superintendent
of Public Works in conjunction with the Tompkins County Cooperative
Extension Service and the Tree Committee.
(3)
The effect of such planting on the convenience and safety to persons
and the potential damage to persons and property.
(4)
No trees shall be planted at locations which may interfere with or
obstruct vehicular or pedestrian travel or otherwise cause a potential
hazard or damage to persons or property.
(5)
Tall maturing trees (maturing at more than 25 feet tall) shall not
be planted under overhead power lines.
B.
Requests from Village residents for the Village to plant or replace
trees in the public right-of-way will be considered by the Village
Board.
A.
The purpose of the Tree Committee is to advise the Board of Trustees and the Superintendent of Public Works on matters which fall under Chapter 306, Trees.
B.
The Tree Committee will consist of the Superintendent of Public Works,
one or two Village Trustees, and two to four volunteer members of
the Village of Dryden community. Volunteer Committee members will
be appointed by the Mayor at the annual organizational meeting and
will serve at the pleasure of the Board of Trustees.
C.
The Tree Committee will meet a minimum of twice per year, in February
and August, to make recommendations regarding tree planting, tree
maintenance and tree removal in the public right-of-way and parks,
to the Board of Trustees.
D.
The Tree Committee may organize volunteer tree care activities, and
actively search and apply for grants with approval from the Board
of Trustees.
