[Adopted by L.L. No. 1-1990 (Sec. 20705 of the 1996 Code)]
As used in this article, the following terms shall have the
meanings indicated:
A place used for the disposal and leaving of solid or liquid
waste by the public or by any person.
Includes an individual, firm, partnership, corporation, municipality
or association or individuals, excluding the Village of Dryden.
All putrescible and nonputrescible solid wastes including
garbage, human sewage, rubbish, ashes, incinerator residue, street
and building demolition and construction debris, metals, abandoned
vehicles, offal, commercial and industrial wastes, and hazardous,
radioactive and toxic wastes as defined by the DEC and the EPA.
A.
Dumping and storage.
(1)
The dumping, storing, or placing of any kind of solid or liquid waste
material within the Village of Dryden which is picked up, brought
or transported from inside or outside the Village of Dryden is hereby
prohibited.

This prohibition shall not be deemed to prohibit the placement of
the following on property within the Village of Dryden:
(a)
Unadulterated topsoil of less than 10 cubic yards; or
(b)
Clean fill if prior approval for the placement of such material
is obtained from the Board of Trustees of the Village of Dryden and
if such material and the placement thereof is in compliance with all
other laws, rules and regulations of all other governmental entities
and agencies, including but not limited to, the County of Tompkins,
New York State, DEC, EPA and the New York State Department of Labor.
B.
The creation and/or operation of sanitary landfills, dumps or dumping
grounds within the Village of Dryden for solid or liquid waste coming
from inside or outside the boundaries of the Village of Dryden is
prohibited.
C.
There shall be no prohibition against the normal garbage and refuse
collection and disposal currently sanctioned by the Village.

Failure to comply with any of the provisions of this article
shall be deemed a misdemeanor, and the violator shall be punished
as set forth on the Village of Dryden Fine Schedule, which Fine Schedule
may be established by resolution and thereafter amended from time
to time by resolution of the Village Board of Trustees. The Village
Board shall also have the power to bring civil action to restrain
any violation of this article in a court of competent jurisdiction.
When a violation of this article is continuous, each 24 hours thereof
shall constitute a separate and distinct offense.
