[Adopted 1-24-1996 as Secs. 60101 through 61103 of the 1996 Code]
The owner of any house, building, or property used for human occupancy, employment, recreation or other public purpose, situated within the Village and abutting on any street, alley or right-of-way in which there is now located or may in the future be located a public water main of the Village, is hereby required, at his/her expense, to install suitable domestic water facilities therein, and to connect such facilities directly with the proper pubic water system in accordance with the provisions of this article, within 90 days after the date of official notice to do so, provided that said public water main is located within 100 feet of the property line.
A. 
Where public water is not available under the provisions of § 332-1, a private system shall be provided complying with the requirements of the County Department of Health.
B. 
A private water source, such as wells, springs or cisterns, may be used in areas served by public water, for nondomestic use, providing that said water is not discharged into the public sewer.
C. 
Unlawful conduct.

(1) 
No person, firm or corporation shall install or permit to be installed any cross-connection whether permanent or temporary between the village water system and any other source of supply of water.
(2) 
No water customer shall cause or allow any water line to be connected to such customer's water distribution system so as to supply any other property or properties with water.
(3) 
No water customer shall resell any water supplied to such customer's property.
(4) 
In addition to the remedies and penalties provided in this subsection and in this article, a fine equivalent to twice the water and sewer bill for the period immediately preceding the discovery of the violation of this subsection shall be imposed upon and paid by such customer.
(5) 
Upon discovery of violation of this rule by any person, firm, or corporation, the Village water service to such person, firm or corporation shall forthwith be disconnected and remain disconnected until this rule is complied with.
A. 
No person shall uncover, make any connection with or opening into, use, alter, or disturb any water main or appurtenance thereof without first obtaining a written permit from the Superintendent of Public Works.
B. 
The owner(s) or his, her or their agent shall make application on a special form furnished by the Village. The permit application shall be supplemented by any plans, specifications and/or other information considered pertinent in the judgment of the Superintendant. If such application is approved, a permit, service connection, meter and inspection fee shall be paid to the Village. Any such required permit application shall be accompanied by the required permit fees as set forth on the Village of Dryden Fee Schedule, which Fee Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees.

C. 
Connections serving multiple buildings.

(1) 
A separate and independent water service connection shall be provided for every building; except where a building stands at the rear of another on the same lot, the service pipe from the front building may be extended to the rear building and the whole be connected to one service connection. There shall be one water service connection for each municipal sewer lateral.
(2) 
The right to connect a service pipe from a front building to a rear building is limited to lots of less than one acre.
D. 
The service pipe shall be as follows: For services of one-inch diameter and up to 75 feet from the water main, Type K soft copper water tubing is required. [Any water service over 75 feet from the water main must use one-inch plastic water pipe (200 lb. copper tube side) with compression fittings only. The pipe has to be in-bedded with No. 2 stone with six inches of cover, and must have a tracer wire connected from the curb box to the meter.] For services of 1 1/4 inches to two inches in diameter, Type K soft copper tuning, or cement-lined, mechanical joint, ductile iron pipe meeting AWWA specifications may be used.

E. 
For services of over two inches diameter, a minimum of four inches diameter, cement-lined, mechanical joint, ductile iron meeting AWWA specifications shall be used.

F. 
The size of the service connection and service pipe shall be subject to the approval of the Superintendent, but in no event shall the diameter be less than one inch.

G. 
No service pipe shall be laid parallel to and within three feet of any bearing wall which might thereby be weakened. The depth shall be no less than 4 1/2 feet.
H. 
There shall be no tap, provision for tap, or plugged tee or other such fittings in the owner's service pipe.
I. 
A compression stop and waste cock must be located inside the building as near as practicable to the wall where the service pipe enters, and the pipe so arranged that the water can be drawn from them whenever there is danger of freezing.
J. 
Meters.
(1) 
Meters shall be set in such location, position and manner as to be readily accessible for reading and repair, and kept free of obstruction.
(2) 
Every meter shall be provided with a compression stop cock on each side and on all meters over one inch in diameter, a suitable bypass with valves on each side of it and a locked valve on the bypass shall be provided, which installation of bypass and valve shall meet with the approval of the Superintendent.
K. 
All excavations required for the installation of the service pipe shall be open-trench work unless approved by the Superintendent. Pipelaying and backfill shall be performed in accordance with AWWA and Village specifications, except that no backfill shall be placed until the work has been inspected.
L. 
The connection of the service pipe shall be made at the curb box. Said curb box shall be located at a point seven feet inside the street right-of-way.
M. 
The owner or his/her agent shall notify the Superintendent when the service pipe is ready for inspection. When trenches are opened for the laying of service pipe, such trenches shall be inspected by the Superintendent before the trenches are backfilled. The filling of a trench before inspection is made will subject the person to whom the permit is issued to a penalty as provided in Chapter 1, General Provisions, Article II, General Penalty, of this Code.
N. 
All excavations for the service pipe installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Village.
A. 
All extensions to the water system owned and maintained by the Village shall be properly designed in accordance with the standards of the American Water Works Association and in strict conformance with all requirements of the County Department of Health. Plans and specifications for water extensions shall be submitted to and approval obtained from the Village of Dryden and the County Department of Health before construction may proceed. The design of water systems must anticipate and allow for the requirements of all possible future extensions or developments within the immediate area.
B. 
Property owners may propose water extensions within the incorporated Village by drafting a written petition, signed by a majority of the benefiting property owners, and filing it with the Village Board. The cost of such extensions may be assessed to the benefitted property owners in any manner determined by the Village Board.
C. 
Water extensions, including individual service connections from the water main to the curb box, may be constructed by the Village under public contract if, in the opinion of the Village Board, the number of properties to be served by such extension warrants its cost. Under this arrangement, the property owner shall pay for and install the service pipes from the curb box to his/her residence or place of business in accordance with the requirements of § 332-3.
D. 
If the Village does not elect to construct a water extension under public contract, the property owner, builder or developer may construct the necessary water extension, if such extension is approved by the Village Board in accordance with the requirements of § 332-4A. He/she or they must pay for the entire installation, including all expenses incidental thereto. Each building service pipe installed must be installed and inspected as previously required, and inspection fees as determined by the Village Board shall be paid. Design of the water system shall be as specified in § 332-4E. The installation of the water extension must be subject to periodic inspection by the Superintendent and the expenses for this inspection shall be paid for by the owner, builder or developer. The Superintendent's decisions shall be final in matters of quality and methods of construction. The water system, as constructed, must pass the tests required in § 332-4F before it is to be used. The cost of water extension thus made shall be absorbed by the developers or the property owners, including all building water pipes.
E. 
The water system design shall be in accordance with the following provisions:

(1) 
All distribution lines shall be ductile iron pipe and fittings or polyvinyl chloride (PVC) pipe and ductile iron fittings. Pipe and fittings shall be provided in the appropriate pressure class and, as a minimum, shall meet the following. Ductile iron pipe shall be cement-lined in accordance with ANSI/AWWA C104/A21.4, minimum Class 51, and conform to the requirements of ANSI/AWWA, C151/A21.51. Push-on and mechanical joints shall conform to the requirements of ANSI/AWWA, C111/A21.11. PVC pipe shall conform to the requirements of ANSI/AWWA C-900, or ANSI/AWWA C-905 Class 150, minimum SDR-18. Fittings shall be mechanical joint, ductile iron conforming to ANSI/AWWA C153/A21.53 and ANSI/AWWA C111/A21.11.

(2) 
All transmission lines shall require the same type of material as specified for distribution lines.
(3) 
Main line valves shall be mechanical joint Ken-Seal gate valves or substitute valves approved by the Village of Dryden. Valves open left (counterclockwise.)
(4) 
Valve boxes shall be the Buffalo Screw Type roadway box, with cover marked "water."
(5) 
Hydrants shall be Clow AWWA compression-type fine-and-one-quarter-inch main valve hydrants, of the type used by the Village of Dryden. All nozzle threads to be national standard. Hydrants shall have two two-and-one-half-inch hose nozzles and one four-and-one-half-inch steamer nozzle.
(6) 
Service connections shall be installed for each lot fronting on the water main extension. The service connection shall be installed from the main to the curb box located at a point seven feet inside the street right-of-way. Said service connection shall consist of a corporation stop, pipe, curb stop, curb box and water meter of the size and type specified by the Village.
F. 
Leakage testing.
(1) 
All water systems shall satisfy requirements of a final leakage test before they will be approved and accepted by the Village. The duration of each leakage test shall be two hours, and during the test, the main shall be subject to a pressure of 100 pounds per square inch in the lowest point in the system.
(2) 
The total leakage shall not exceed 75 U.S. gallons per inch of nominal diameter per one mile in a 24 hour period. All defective pipe or leaks must be corrected to the satisfaction of the Superintendent.
G. 
Acceptance and guarantee.
(1) 
All water extensions constructed at the property owner's, builder's or developer's expense, after final approval and acceptance by the Village, shall become the property of the Village and shall thereafter be maintained by the Village.
(2) 
Said water systems after their acceptance by the Village, shall be guaranteed against defects in materials or workmanship for 18 months. The guarantee shall be in a form provided for by the Village. At the sole discretion of the Village a completion bond or certified check may be demanded as part of the guarantee.
H. 
No builder or developer shall be issued a building permit for a new dwelling or structure requiring water facilities within the Village unless a suitable water source is proposed. All new developments shall be provided with a public water system, unless otherwise permitted by the Village Board and County Department of Health.
A. 
No customer or other person shall willfully waste any water supplied by the Village of Dryden or any water therein by the loss of water through imperfect pipes or by any means.
B. 
Air-conditioning and refrigeration systems.
(1) 
Air-conditioning and refrigeration systems with a capacity of three tons or less shall not use water directly or indirectly (except when used with conservation equipment) from the public supply.
(2) 
Systems with a total capacity of more than three tons but not exceeding five tons may use water directly from the public supply at a rate not exceeding 2.0 g.p.m. per ton if the water temperature is 75° F. or less, or 3.0 g.p.m. per ton if it is above 75° F., provided that they are equipped with an automatic regulating valve which will:
(a) 
Stop the flow of water when the refrigerating machine is shut down; and
(b) 
Throttle the flow of water down to the momentary requirements of the system.
(3) 
All systems having a total capacity exceeding five tons shall be equipped with evaporative condensers, cooling towers, spray ponds, or other water cooling equipment. This equipment shall be of sufficient capacity to ensure conformance with the requirements of Table 1 for makeup water when operating under full loading at maximum summer temperature.

Standpipes or pipes for automatic suppression of fires in building, which fixtures are intended only for such use, will be permitted to be attached to the Village water supply system, and no charge will be made for the use of water for such purposes. All such pipes must be provided with a suitable valve outside of the building and which shall be under the exclusive control of the Village. Also, in the case of standpipes, a valve must be provided and placed at the bottom of the standpipe and at each hose opening, which valve shall be sealed by the Village Water Department. In case such seals shall be broken for the extinguishment of any fire, the party breaking the seal shall immediately thereafter notify the Superintendent and the valve shall be resealed.
D. 
The Village Board and its representatives reserve the right to restrict or prohibit the use of water for sprinkling purposes or other nonessential purposes at such times and for such periods as it deems necessary or proper; and all directives by the Village Board or its duly authorized representative relative to the curtailment or prohibition of the use of water for sprinkling or other nonessential purposes shall be complied with.
E. 
Whenever leaks occur in the service pipes at any point between the curb box and the meter, they must be repaired immediately by the owner or agent of the premises. If repairs are not made within 15 days after notice of such leaks, water shall be shut off until such repairs are made.
F. 
The Village of Dryden reserves the right, at any time, without notice to shut off the water in its mains for the purpose of making repairs and extensions or for other purposes; and in no event shall the Village or its officers, representatives or employees be liable for a deficiency in supply of water or the pressure thereof.
G. 
The Village water pressure is produced by a "static head" and therefore is dependent upon the elevation of the customers' premises. In the higher elevations of the Village where the water pressure is not satisfactory to the consumer, the customer, at his/her expense, may install private pumping equipment.
H. 
Curb stops on water services shall be operated only by employees of the Village of Dryden or by such other person authorized by the Village Board.
I. 
Hydrants.
(1) 
In order to provide good quality, safe drinking water to the Village water customers, it is necessary to regulate how and when water shall be taken from the Village system. No person shall open, use, draw from or in any manner interfere with any emergency fire hydrant without authority from the Village Superintendent of Public Works or another state-certified water operator with Superintendent's authorization. This prohibition shall not apply to firefighters in the case of a fire emergency. No person shall break, deface, injure, remove, or open any part thereof, and no person shall use any wrench on any hydrant other than a standard hydrant wrench. Except as set forth below, no service line shall be connected to the Village water system having a non-fire-system device capable of discharging more than 100 gallons per minute. Any such device currently existing may be sealed by the Water Department within 30 days of the enactment of this article and used only in the case of a fire emergency. No new service line shall be connected to the Village water system which has the potential of discharging more than 100 g.p.m. unless certified by a licensed engineer that the projected flow will not increase turbidity in any other part of the Village water system. Failure to comply with any of the provisions of this section shall be deemed a violation, and the violator shall be punished as set forth on the Village of Dryden Fine Schedule, which Fine Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees.

(2) 
No person shall erect or plant any obstruction within 3 1/2 feet of any hydrant or cause any obstruction that will in any way hinder a fire company from hooking onto it or operating any hydrant. No obstruction shall be placed so as to obstruct the view of any hydrant for a distance of at least 200 feet up and down the street.
(3) 
No person shall paint or in any way change the color from the standard color used by the Village Water Department in painting hydrants.
J. 
Meters.
(1) 
Meters must be accessible to Village employees at all reasonable hours.
(2) 
If meters need attention, the Superintendent must be notified at once. No person other than Village employees shall be allowed to remove meters for repairs or for any other purpose.
(3) 
All persons are forbidden to break meter seals or disconnect or in any way tamper with meters after they have been installed on the premises.
K. 
Any owner may have his/her meter checked for accuracy by signing an agreement stating that he/she will pay the standard service charge only if the meter in question is proven to be accurate by the tester.
L. 
The Board of Trustees is authorized to establish the fees to be paid for the purchase of water from fire hydrants, such fees to be set forth on the Village of Dryden Fee Schedule, which Fee Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees. The Board of Trustees is also authorized to establish, by resolution, all regulations with respect to such purchase, which regulations may be amended from time to time by resolution of the Village Board of Trustees.

A. 
No person shall maliciously, willfully, or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance, or equipment which is a part of the Village water works. Any person violating this subsection shall be subject to immediate arrest under charge of disorderly conduct.
B. 
A contractor must present a certificate of insurance showing suitable liability insurance before a permit will be issued for construction of water pipes, water extensions, or private water systems.
C. 
The property owner must protect the meter from freezing and damage. Any damage to meters caused by other than normal wear will be repaired by the Village at the expense of the property owner.
A. 
The Superintendent, the Engineer, and other duly authorized employees of the Village bearing proper credentials and identifications shall be permitted to enter upon all properties for the purpose of inspection, observation, reading meters, sampling and testing, in accordance with the provisions of this article.
B. 
At such time as work requiring inspections by the provisions of this article has been completed and is ready for such inspection, the property owner, builder or developer shall notify the Superintendent and request such inspection, which shall be done as promptly as possible.
A. 
Failure to comply with any of the provisions of this article shall be deemed a violation, and the violator shall be punished as set forth on the Village of Dryden Fine Schedule, which Fine Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees.

B. 
As an alternative, upon violation of this article, the proper authorities of the Village, in addition to other remedies, may institute any appropriate action or proceedings, including an injunction, to prevent such unlawful use, construction or maintenance of water systems, wells or pipes, to restrain, correct or abate such violation and/or to prevent the occupancy of any building structure or land where said violations of this article are found.
C. 
Any person violating any of the provisions of this article shall become liable to the Village for any expense, loss, or damage occasioned the Village by reason of such violation.
A. 
The primary source of the revenues for retiring debt services, capital expenditures, and operation and maintenance of the public water system shall be assigned to owners of property connected to the public water system.
B. 
Water service charge rates shall be determined by the Board of Trustees on a year-to-year basis. In general, charges will be calculated from a schedule based on consumption or on a schedule of minimum charges, whichever is the greater. The water service charge will be computed and billed quarterly.

C. 
Each water charge levied pursuant to this article is hereby made a lien on the premises, and if the same is not paid within 60 days after it shall be due and payable, it shall be certified to the Treasurer of the Village who shall place the same on the real property tax bill for that year with interest and penalties allowed by law, and be collected as other Village taxes are collected.

A. 
In addition to any other remedies provided by law or ordinance, all water service charges, accounts, or other charges, accounts, or other charges relating to water service shall be a charge against the owner or agent of the premises connected with the Village water supply, and such owner or agent shall be held responsible for all such accounts and charges together with a penalty of 10% of such charge, account or other charge, which penalty shall be charged after 30 days of the billing of said water service charge, account or other charge. After 60 days, an additional monthly late payment penalty shall be added until such time as the bill(s) and penalties are included in the annual Village tax levy, such additional monthly penalty percentage to be:

(2) 
No greater than the maximum percentage permitted by law.
B. 
In default of payment of any such water service charge, account or other charge within 60 days after becoming due together with the penalty thereon as provided above, the water service may be cut off such premises without further notice.
C. 
There shall be charged a fee to disconnect and reconnect any water service which has been shut off because of nonpayment of any water service charge, account, other charge, penalty or any other reason, such required fee being as set forth on the Village of Dryden Fee Schedule, which Fee Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees. No water service shall be reconnected until the required fee, together with the original past-due amount and any penalty charges thereon, shall be paid in full to the Village.
