AVAILABLE OVERNIGHT SHELTER
A. 
A public or private shelter, with an available overnight space, open to an individual experiencing homelessness at no charge.
B. 
A hotel or motel that is made available to an individual experiencing homelessness at no charge.
CAMP
To pitch, use, or occupy camp facilities for the purposes of habitation, as evidenced by the use of camp paraphernalia.
CAMP FACILITIES
Includes, but is not limited to, tents, huts, and temporary shelters. "Camp facilities" does not include tents, huts, or temporary shelters when used temporarily in a park for recreation or play during daylight hours when the park is open to the public.
CAMP PARAPHERNALIA
Includes, but is not limited to, tarpaulins, cots, beds, sleeping bags, blankets, mattresses, hammocks or cooking facilities or equipment.
PARK
Any publicly owned area controlled by the Village or other governmental entity for park purposes. "Park" also includes all associated areas, including parking lots for parks.
PREMISES
Includes the term "structure" and any real property.
PUBLIC PROPERTY
Any real property, building, structure, equipment, sign, shelter, vegetation, trail, and public open space, including all associated areas such as parking lots, controlled or owned by the Village or any other governmental agency.
STORE
To put aside or accumulate for use when needed; to put for safekeeping; to place or leave in a location.
STREET
Any highway, lane, road, street, right-of-way, sidewalk, boulevard, alley, and every way or place in the Village of Dryden open as a matter of right to public pedestrian and vehicular travel.
A. 
Village yard waste landfill on Bradshaw Road.
(1) 
No person shall knowingly enter or remain unlawfully in or deposit material in the premises designated as the Village yard waste landfill, water/pump houses, sewer plants, DPW facilities, or the access roads thereto.
(2) 
No person shall deposit material in the Village yard waste landfill except for employees of the Village Department of Public Works in the course of their duties as Village employees and under the direction of the Superintendent.
(3) 
It is acknowledged that Village residents may self-transport and deposit their own yard waste, upon receiving permission as indicated by sign-out and receipt of the key from the Village Clerk. Only yard waste, defined as organic or geologic material originating on personal property within the Village, exclusive of dead animals, is permitted. If it is found that nonsuch material is deposited, the offending person shall be responsible for all costs associated with and related to the proper removal and disposal of such material in accordance with all then applicable federal, state and local laws.
B. 
Village reservoirs. No person shall knowingly enter or remain unlawfully in the premises designated as the Village reservoirs or the access roads thereto.
C. 
Village property. No person shall knowingly enter or remain unlawfully in the premises designated as the Village property.
D. 
A person enters or remains unlawfully in or upon premises when he/she is not licensed or privileged to do so. A person who, regardless of his/her intent, enters or remains in or upon the premises which are at the time open to the public does so with license and privilege unless he/she defies a lawful order not to enter or remain, personally communicated to him/her by the owner of such premises or other authorized person.
A. 
It shall be unlawful for any person to camp or to store personal property, including camp facilities or camp paraphernalia, in the following areas:
(1) 
Any park; or
(2) 
Any street; or
(3) 
Any public property, improved or unimproved.
B. 
Homelessness; available overnight shelter.
(1) 
Prior to issuing any citation or arrest pursuant to this chapter, the investigating officer shall inquire whether the unlawful camping and storage of personal property is due to homelessness. If the officer learns that such is the case, the officer shall determine, in accordance with relevant department policy, whether there is available overnight shelter to accommodate the subject of the investigation. If the officer determines there is no available overnight shelter, the officer shall not issue a citation.
(2) 
If the officer determines there is available overnight shelter, the officer may, within his/her discretion:
(a) 
Provide directions to the shelter location.
(b) 
Offer one-time transport to the shelter location(s).
(c) 
Any individual who refuses to accept the shelter space offered is subject to penalty as set forth in § 229-4.
Failure to comply with any of the provisions of this chapter shall be deemed a violation, and the violator shall be punished as set forth on the Village of Dryden Fine Schedule, which Fine Schedule may be established by resolution and thereafter amended from time to time by resolution of the Village Board of Trustees.
