A.
There is hereby adopted as the Boarding Homes For
Children Code of the City of Clifton the whole of Chapter VI of the
New Jersey State Sanitary Code, entitled "Boarding Homes for Children,"
having as its effective date, April 1, 1963.
B.
Said Chapter VI of the New Jersey State Sanitary Code
is hereby incorporated in this chapter and made a part hereof as though
it had been set forth at length.
C.
Three copies of said Chapter VI of the New Jersey
State Sanitary Code have been placed on file in the office of the
City Clerk and in the office of the Health Department and shall remain
on file in each of said offices for the use and examination of the
public so long as this chapter shall remain in effect.
Application for the license required by the
Boarding Homes for Children Code of the City of Clifton shall be made
to the City Clerk, who, upon receipt of such application, shall obtain
the certificates required by Section 2.2 of said code and forward
the application and certificates to the Board of Health.
The following regulations shall apply to the
conduct or maintenance of a boarding home for children licensed under
this chapter and under the Boarding Homes for Children Code of the
City of Clifton, in addition to any other provision in this chapter
or in the Boarding Homes for Children Code of the City of Clifton:
A.
The premises shall, at all times, be attended by one
or more responsible adult persons. Such persons and all members of
their households shall be free of any communicable diseases.
B.
All buildings and appurtenant surrounding premises
shall be subject to and open for inspection at all reasonable times
by the City Health Officer or his designated agents.
C.
All rooms shall be well lighted and sufficiently ventilated
by windows opening to the outer air.
D.
Doors and windows shall be adequately screened to
exclude flies, mosquitoes and gnats.
E.
All children shall be examined by a licensed physician
at least once every year after entering or enrolling in any boarding
home. Each examination shall be recorded on a form provided by or
acceptable to the Board of Health and signed by the physician.
F.
In the event of the death of a child while in the
care of a boarding home for children, the name and address of the
physician attending said child at the time of death shall be entered
upon the records of the boarding home.
G.
Pillows and mattresses used shall be entirely covered
by a moistureproof material.
H.
The use of hairbrushes by children in the care of
a boarding home for children is prohibited.
I.
The boarding home shall provide sufficient clothing
for wear in the home and to redress children in case of accident or
in the event that any child should come to the boarding home in an
unclean condition. All such clothing shall be thoroughly washed before
being reused.
J.
All soiled linens, diapers and articles of infant
clothing shall be freed from fecal or other waste material and shall
be then immediately placed in a covered receptacle provided for this
purpose.
K.
Drinking water supplied by sanitary means shall be
readily accessible. Individual drinking cups shall be provided. No
water supply other than the public supply shall be used unless first
approved by the Board of Health.
L.
Provision shall be made for the comfort of the children
during meals. All meals and snacks shall be served indoors. Adequate
eating equipment, which the child can easily handle, shall be provided.
M.
A first-aid kit shall be readily available at all
times and kept adequately stocked for emergency treatment. The person
in charge of the children shall be qualified to administer first aid
in accordance with the standards set by the American Red Cross.
N.
Foodstuffs and utensils shall be cared for in the
following manner:
(1)
All foodstuffs shall be kept in clean, covered receptacles;
and all perishable foodstuffs, normally requiring refrigeration, shall
be so refrigerated.
(2)
Milk shall at all times be stored at a temperature
between 40º F. and 50º F.
(3)
Milk bottles, nipples and cooking utensils used in
infant feeding shall be cleansed and sterilized in accordance with
the directions of the examining physician.
(4)
Garbage receptacles, which shall be covered and of
adequate size, shall be provided. The contents shall be removed from
the premises daily, and the receptacles shall be cleaned and scalded
after emptying.
Any person who violates any provisions of this
chapter or of the Boarding Homes for Children Code of the City of
Clifton shall, upon conviction thereof, be punished by a fine not
exceeding $100 or by imprisonment for a term not exceeding 90 days,
or both. A separate offense shall be deemed committed upon each day
during which or on which a violation occurs or continues.
If any article, section, subsection, sentence,
clause or phrase of this chapter is for any reason held to be unconstitutional
or invalid or is modified or annulled by the Public Health Council
of the State of New Jersey, such determination, modification or annulment
shall not affect the remaining portion of this chapter, which shall
be deemed severable.
This chapter shall take effect after final passage
and publication as required by law and upon approval hereof of the
Public Health Council of the State of New Jersey.
Sections 18-1 to 18-20, inclusive, of the Revised
Ordinances of the City of Clifton be and they are hereby repealed.
