The operation of personal assistive mobility devices
as those devices are defined in § 1 of P.L. 2001, c. 430
(N.J.S.A. 39:4-14.10) and the operation of electric-powered scooters,
either with or without seats, is hereby prohibited in the Borough
of Beach Haven: 1) on any sidewalk, bicycle path, public parking lot
or any other public property; 2) on any portion of Atlantic Avenue
between 12th Street and Pearl Street; 3) any portion of Beach Avenue
between 12th Street and Pearl Street; 4) any portion of Bay Avenue
between 12th Street and Pearl Street.
Any person apprehended operating an electric-powered
scooter, either with or without seats, or an electric personal assistive
mobility device shall, on the first offense, be fined not less than
$100 nor more than $250; for a second offense, shall be fined not
less than $250 nor more than $500, and for a third offense, be fined
not less than $500 nor more than $1,000.
The electric-powered scooter or the electric personal
assistive mobility device operated by any person violating the terms
of this section may be impounded by the Police Department for a period
of not more than 15 days for the first offense, not more than 30 days
for the second offense, and not more than 90 days for the third offense.[1]
