No person shall pile or cause to be piled scrap rubber, tire-derived materials or more than 10 tires within 150 feet of any residence or within 100 feet of any other type building or within 100 feet of any fire hydrant. Due to unusual circumstances, such as building location or property sizes, the Bristol Township Fire Marshal may grant approval for piling such materials less than 100 feet from any building, such approval to be for a period not to exceed 90 days but which may be renewed from time to time by the Fire Marshal.
A. 
Indoor storage. Indoor storage of scrap rubber, tire-derived materials and tires shall be consistent with the Standard for Storage of Rubber Tires, NFPA No. 231D, as amended.
B. 
Outdoor storage.
(1) 
Area height limitations. No person shall pile scrap rubber, tires or tire-derived materials in an area exceeding 2,500 square feet or more than 15 feet in height.
(2) 
Aisles. Any person piling scrap rubber, tires or tire-derived materials as provided in Subsection B(1) shall cause an aisle to be placed between such piles, such aisle to be a minimum of 20 feet in width.
C. 
No person may store scrap rubber, tires or tire-derived materials for more than one year, unless 75% of the total number of tires (including scrap rubber or tire-derived materials) that were present at the site during the preceding calendar year were processed or disposed of. This rate of recovery must be verified by valid contractual agreements.
D. 
Any person that stores tires (including scrap rubber or tire-derived materials) shall maintain accurate operational records that are sufficiently detailed to clearly demonstrate to Bristol Township that tires are being stored in accordance with Subsection C. Such records shall be available on site and made available to Bristol Township officials.
E. 
Any person storing tires (including scrap rubber or tire-derived materials) shall maintain accurate disposal records, to include the number of tires, hauler, person(s) and location(s) to which they were shipped and the end use for which they were shipped. Such records shall be available on site and made available to Bristol Township officials.
No scrap rubber, tires or tire-derived materials shall be piled in accordance with this section within a distance of 50 feet from any grass, weeds, brush or other combustible or flammable materials.
No smoking shall be permitted on the grounds or building where any scrap rubber, tires or tire-derived materials are stored. An appropriate number of NO SMOKING signs must be posted.
A. 
A sufficient number of portable fire extinguishers shall be placed at tire storage areas. The size, type and location shall be approved by the Fire Marshal.
B. 
Storage of 500 or more tires (including scrap rubber and tire-derived materials).
(1) 
Fire hydrants, with a minimum capacity of 750 gallons per minute, shall be located at the owner's expense so as to facilitate the fighting of fires as specified by the Fire Marshal; no more than 300 feet of hose shall be required to reach any portion of the storage area as provided in this section.
(2) 
Any person who stores tires, scrap rubber or tire-derived materials shall have a Bristol Township approved Preparedness, Prevention and Contingency (PPC) Plan that is consistent with the most recent guidelines for the development and implementation of preparedness, prevention and contingency plans.
A. 
Any person that stores tires (including scrap rubber or tire-derived materials) shall eliminate conditions conducive to the harborage, breeding or attraction of vectors.
B. 
Any person that stores tires (including scrap rubber or tire-derived materials) shall also prevent and eliminate conditions not otherwise prohibited by this chapter that are harmful to the public health, public safety or the environment or which create safety hazards, odors, dust or other public nuisances.
The outside storage of 500 tires (including scrap rubber and tire-derived materials) or more shall be bounded by an impervious berm each 36 inches in height, with appropriate drains through the berms equipped with a valving system that is easily closed in case of emergency.
Any person storing tires or tire-derived materials within the confines of Bristol Township must comply with all Pennsylvania Department of Environmental Resources rules, regulations and policies regarding the storage of tires and tire-derived materials. This chapter shall not be construed as authorizing the storage of tires or tire-derived materials. The regulations promulgated by this chapter are in addition to any and all rules, regulations and policies adopted by the Pennsylvania Department of Environmental Resources, and any person storing tires or tire-derived materials as provided herein is required to comply with all rules, regulations and policies of the Pennsylvania Department of Environmental Resources regarding the storage of tires and tire-derived materials.
No person, firm or corporation shall dispose of tires, scrap rubber or tire-derived materials in the boundaries of Bristol Township other than as per § 183-2E.
Should any person, corporation, firm, partnership or other legally recognized entity violate any provision of this chapter, Bristol Township shall file an action in the court of appropriate jurisdiction, and upon a judgment in favor of Bristol Township said person, firm, corporation, partnership or legally recognized entity shall be ordered to pay to Bristol Township, in addition to any and all other relief granted by the court, a penalty of up to $1,000 per violation. Each day that a violation exists shall constitute a separate and distinct violation of this chapter.
This chapter shall not be construed as authorizing creation of tire storage facilities or authorizing tire storage within Bristol Township. If a facility is properly authorized to store tires pursuant to the Pennsylvania Department of Environmental Resources,[1] then that facility shall be permitted to maintain a storage facility within Bristol Township upon compliance with the requirements of this chapter.
