The Village of Rouses Point shall not be liable for damage or injury
to persons or property alleged to have been caused or sustained from or in
consequence of a defect or unsafe condition in any sidewalk, street, highway,
crosswalk, grading, opening, gutter, bridge, culvert, curbstone, drain or
sewer or any other condition existing in a highway or sidewalk unless actual
notice of such defect or unsafe condition shall have been served in writing
on the Superintendent of Public Works at least five days prior to sustaining
such damage or injury, whether such damage or injury shall be alleged to have
been sustained by reason of the neglect or fault of the Village or otherwise.
