Except as hereinafter provided, no owner, tenant or occupant of any premises in the Borough of Kinnelon shall cause or permit any can, box, barrel, bundle, bag, container or other receptacle for the collection, accumulation, storage and disposal of garbage, trash or rubbish to be placed, kept, stored, maintained or otherwise located on such premises closer than 20 feet to any adjoining property line or in or upon the front yard of any structure erected upon such premises. The term "front yard" shall be deemed to include the full width of the lot or lots occupied by such structure and, in the case of corner lots, shall include all yards abutting upon any and all streets.

A. 
For the purpose of collection by the duly appointed scavenger contractor of the Borough of Kinnelon, but subject to regulations imposed thereby, said garbage, trash and rubbish receptacles may be temporarily placed and kept at or near the side line of a street abutting said premises between 5:00 p.m. on the day immediately preceding the day duly designated and scheduled for such collection and 8:00 a.m. of the day immediately following the actual collection by said scavenger contractor. After such collection, but in any event prior to the expiration of said period, each empty receptacle shall be returned to a location as specified in § 127-4 hereof. Newspapers, if tied in bundles, and other discarded articles such as furniture intended for collection by the scavenger contractor but which are too large or bulky to be placed in receptacles shall be subject to the limitations set forth herein.
B. 
Unless provided to the contrary in the collection contract between the Borough and the duly appointed scavenger contractor, all collections shall be made between the hours of 6:00 a.m. and 6:00 p.m., prevailing time, Mondays through Saturdays. There shall be no collection on Sunday.

This article shall be administered by the Building Inspector of the Borough of Kinnelon, and he is hereby authorized to vary the distance limitations imposed herein wherever the topography of the lot, size or condition thereof renders strict compliance therewith impracticable.
It is intended that this article shall be construed in conjunction with and shall be supplemental to all other applicable ordinances of the Borough of Kinnelon and of the several agencies thereof. This article shall be enforced by all law enforcement officers of the Borough of Kinnelon.

Any person, firm or corporation violating this article shall be subject, upon conviction, to one or more of the following at the discretion of the court: a fine not to exceed $1,000 or imprisonment in the county jail for a term not to exceed 90 days or community service not to exceed 90 days.
