C.
In the absence of such criteria, the Mayor and Council hereby establish the following criteria:
(1)
The calculated percentage of the clothing allowance shall be based annually from November 1 of the previous year to October 31 of the year in which the clothing allowance is payable. The Department Chief is responsible for correctly calculating the clothing allowance due to all eligible members. The percentage is based on the total number of calls, drills, department meetings and company monthly meetings. All company captains shall keep a record of such total numbers for all of the fire personnel within their company in order to calculate the annual percentage. Such calculated percentages shall be submitted by them to the Board of Fire Officers at the November Fire Board meeting.
(a)
Firefighters with less than seven years of consecutive service on the Maywood Fire Department are required to attain a minimum of 60% of the number of total calls and drills only in order to receive 100% of their clothing allowance. Company Captains shall separate these individuals from the rest of the membership on their calculated percentage sheets.
(b)
Firefighters with seven years but less than 20 years of consecutive service on the Maywood Fire Department are required to attain a minimum of 50% of the number of total calls, drills, department meetings and company meetings to receive 100% of their clothing allowance.
(c)
Firefighters with 20 years but less than 25 years of consecutive service on the Maywood Fire Department are required to attain a minimum of 40% of the total number of calls, drills, department meetings and company meetings to receive 100% of their clothing allowance.
(d)
Firefighters with 25 or more years of consecutive service on the Maywood Fire Department are required to attain a minimum of 25% of the total number of calls, drills, department meetings and company meetings to receive 100% of their clothing allowance.
(2)
Firefighters or department officers who are below their minimum percentage shall receive a prorated share of their category base amount, based on their calculated percentage for that year. Any firefighter coming off probation will receive a prorated share of the clothing allowance for that year.
(3)
The estate of any active firefighter who expires during the annual period from November 1 of the previous year to October 31 of the year in which the clothing allowance is payable shall receive a full year of the base category amount of his/her clothing allowance for that year only.
(4)
Any active firefighter who becomes ill or injured in the performance of his/her official duties as a Maywood firefighter will receive credit for all calls, drills, department meetings and company meetings during his/her time of convalescence in calculating his/her adjusted base clothing allowance.
(5)
After all percentages are calculated, the base clothing allowance for each eligible member shall be adjusted as set forth above. Any remaining funds from the total amount appropriated for clothing allowance for the Fire Department less the total of the adjusted base clothing allowance for all eligible members shall be equally distributed, on a per-capita basis, to all eligible members who have attained or exceeded their required percentage of calls, drills and meetings for that year.
