From and after the effective date of this article, it shall be unlawful for any person, firm or corporation, either intentionally or unintentionally, to dump or deposit upon any lands within the Borough of Pleasant Hills any quantity of earth, dirt, stones, rocks or other materials having a volume greater than 27 cubic yards, unless a permit to so deposit and dump is first obtained from the Borough of Pleasant Hills.
The Borough Engineer of the Borough of Pleasant Hills is hereby charged with the duty and responsibility of supervising and regulating the dumping and depositing of earth, dirt, stones, rocks or other materials within the Borough of Pleasant Hills and he is hereby empowered to make such rules and regulations as he may deem necessary to protect the lives and property of the residents of the Borough of Pleasant Hills. Any rules or regulations made by the Borough Engineer shall be in conformity with generally accepted engineering principles and standards.
The rules and regulations adopted and promulgated by the Borough Engineer of the Borough of Pleasant Hills shall be maintained on file in the office of the Borough Secretary of the Borough of Pleasant Hills and shall be available for inspection by any person during regular business hours.
Any person, firm or corporation who may violate the provisions of this article shall first be notified by the Borough Engineer of the Borough of Pleasant Hills to correct, remove or abate such violation within a period of 72 hours. In the event such condition is not corrected at the expiration of 72 hours after receipt of proper notice, then such person, firm or corporation shall be subject to a fine of $10 per day for each day that such condition exists in violation of the provisions of this article. Each day shall be considered a separate violation subject to a separate fine as herein provided. The proper Borough officials are hereby authorized to enforce the penalty provisions of this article before any of the District Justices of the Borough of Pleasant Hills as in such cases made and provided.
