The document known as and designated as "The International Property Maintenance Code, 2018 Edition," as published by the International Code Council, Inc., is hereby adopted as the Property Maintenance Code of the Borough of Pleasant Hills in the Commonwealth of Pennsylvania for the control of buildings and structures as herein provided. A copy of the 2018 Edition of the International Property Maintenance Code shall be retained in the Borough Office for purposes of enforcement. Each of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code are hereby referred to, adopted and made part hereof as if fully set forth in this chapter, with the additions, insertions, deletions and changes set forth therein. It is the express purpose of the Borough Council of the Borough of Pleasant Hills that the terms and provisions of the Property Maintenance Code shall be adopted as the requirements of the Borough of Pleasant Hills and that the Borough of Pleasant Hills shall adopt such amendments to the International Property Maintenance Code as said Code may be amended.
Ord. Nos. 737 and 232 and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.[1]

The International Property Maintenance Code is amended and revised in the following respects:

B. 
Except as set forth herein, it is the intention of the Borough Council of the Borough of Pleasant Hills to follow the International Property Maintenance Code as said Code may be amended in the future and that the ordinances of the Borough of Pleasant Hills shall maintain consistency with the terms and provisions of the International Property Maintenance Code.

A. 
In case any owner or occupant shall fail to comply with any notice to correct or abate any condition which may adversely affect the health and welfare of the public pursuant to the provisions of this chapter, the Borough Code Enforcement Officer or Zoning Officer may elect to enter the property and proceed to have the condition removed, corrected or abated and shall charge said owner or occupant the actual cost to the Borough for the labor involved, the material involved, and the use of equipment, together with a penalty of $500. Any charges remaining unpaid after 30 days' written notice shall be turned over to the Borough Solicitor for collection in the manner provided by law for the collection of municipal claims or in an action at law before the District Judge or the Court of Common Pleas.
B. 
The charges described above for labor, material and equipment, together with a penalty of $500 shall only apply in the event that the Borough elects to enter the property and proceeds to have the condition removed, corrected or abated. The Borough is not required to remediate any such violations, but rather may elect to notify the property owner that the property owner is responsible for such abatement of violations.

C. 
In the event a violation of The International Property Maintenance Code 2009 Edition, or a violation of a subsequent edition of the International Property Maintenance Code, as may be amended, has been found to occur, rather than impose the above procedure and charges, the Borough may issue a citation for each such violation, and the fine for each violation shall be $100 per occurrence. Each day that the condition/violation continues to exist shall be recognized as a separate violation and subject to an additional $100 per each day the violation remains. Violations of the International Property Maintenance Code shall be determined by the requirements of the current edition of said code in existence at the time the violation occurs.

Appeal process. Any person aggrieved shall have the right to appeal a decision under this Code pursuant to the following procedure:
A. 
Any person aggrieved by a decision or order issued under this code may appeal to Borough Council within 10 days after the date of the decision, notice or order was served. Such appeal shall be considered by Council, employing such professional assistance as Council shall, in its sole judgment, require, within 30 days. The decision of Council shall be made within 30 days after consideration, and the decision of Council shall be final.
B. 
In any case where Council determines the appeal is not well founded, any person aggrieved thereby may, within 10 days thereafter or such other time as may be set by Rules of Court, appeal therefrom by petition to the Court of Common Pleas of Allegheny County as provided by law.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any Act or ordinance hereby repealed as cited in § 268-2 of this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
