From and after the effective date of this chapter, any person, firm or corporation who shall erect or construct any residential dwelling house in the Borough of Pleasant Hills shall, before an occupancy permit therefor is issued by the Zoning Officer of Pleasant Hills, issue to the buyer, assignee or occupant of said dwelling house, a written warranty that all ordinances of the Borough of Pleasant Hills relating to the construction and erection of said dwelling house have been complied with fully and completely. This warranty shall be delivered to the buyer, assignee or occupant of said dwelling house prior to the actual transfer of occupancy of said dwelling house. The said warranty shall be for a period of 10 years, and shall run to the immediate buyer, assignee or occupant and to his successors and assigns during the ten-year period of the warranty. Notwithstanding any other part of this chapter, the said warranty required herein shall be deemed to expire and cease 10 years after the original construction of said dwelling.

The Zoning Officer of the Borough of Pleasant Hills shall maintain a record of all occupancy permits issued and of the name and address of the person issuing the warranty required by this chapter and a copy of the warranty so issued. These records shall be open and available to the public during all business hours of the Borough.

The Zoning Officer of Pleasant Hills shall maintain a list of the Borough ordinances to which the warranty shall apply. These ordinances shall be listed on the warranty as given. If any person shall believe that one or more of the ordinances contained in the Zoning Officer's list of applicable ordinances is improper or illegal, he shall have a right of appeal to Borough Council, whose decision in this matter shall be final and conclusive.
This chapter shall in no way be deemed to supersede or repeal any existing ordinance of the Borough of Pleasant Hills.
