On and after the effective date of this chapter, it shall be unlawful
to plant any poplar or willow trees at or near any place where the same may
send its roots into, or clog any part of the sanitary sewer system of the
Borough of Pleasant Hills, or in any way interfere, obstruct, harm or destroy
the same, or any part thereof.
Any person who has planted or maintains a tree such as a poplar or willow as is prohibited in §
344-1 hereof shall be given written notice to have the same removed and destroyed, so as to prevent any obstruction, interference or harm to the said sanitary sewer system or any part thereof.
Upon failure or refusal on the part of any person or persons planting
or maintaining same, said person or persons shall be deemed to be in violation
of the provisions hereof.
Any person or persons planting or maintaining any poplar or willow trees,
who fails to abate, remove or destroy same after 72 hours' notice thereof
by the Borough of Pleasant Hills, or any of its agents, shall, upon conviction
before the District Justice, be subject to a fine of not more than $100, and
in default of payment of said fine and costs, shall be committed to the Allegheny
County Jail for a term not exceeding 30 days. Each day in which said person
or persons fail to remove and destroy said trees, after notice thereof in
accordance with the provisions hereof, shall be deemed to be a separate offense.
