It shall be unlawful for any person to handle,
wield, manipulate, or in any manner whatsoever to use or employ any
machine, mechanical device, vehicle, weapon, tool or any other instrument
while influenced or affected by alcohol or hypnotic drugs in such
manner as would or may endanger or place in jeopardy the life, limbs
or property of any one, including the property of any association
or corporation.
Any person violating the provisions of this
article shall, upon conviction before any District Justice within
the Borough, be liable to a fine of not less than $10, nor more than
$50 for each offense, or to imprisonment in the Borough lockup for
a period not exceeding five days, or in the county jail for a period
not exceeding 30 days, or either fine or imprisonment or both within
the discretion of the District Justice.
