This chapter shall be known as and shall be cited as the "Alarm Devices Code."
For purposes of this chapter, the following terms are defined as follows:
ALARM
A communication to the City of Greensburg Police Telecommunications Center indicating that a crime, fire or other emergency situation warranting immediate action by emergency personnel has occurred or is occurring.
ALARM DEVICE
Any device designed to automatically transmit an alarm by wire, telephone, radio or other means to an individual, corporation, partnership, incorporated association or other similar entity who is instructed to notify the City of Greensburg Police Telecommunications Center for the purpose of the alarm.
FALSE ALARM
An alarm to which emergency personnel respond, resulting from the activation of an alarm device when a crime, fire or other emergency warranting immediate action by emergency personnel has not, in fact, occurred.
PERSON
An individual, corporation, partnership, incorporated association or other similar entity.
A. 
A city resident, business proprietor or other person in actual physical control of an alarm device shall pay the City of Greensburg a charge for each false alarm emanating from his alarm device during any calendar year as follows:

B. 
When a fifth false alarm from the same alarm device occurs within the same calendar year, the City of Greensburg, within 15 days from the date of the fifth false alarm, shall notify the person in actual physical control of the alarm device from which the alarm emanated that further false alarms in the calendar year will result in an assessment of charges as set forth in § 92-6A. Such notice shall be in writing and mailed to the last known address of the person in actual physical control of the alarm device. Said notice shall be by regular mail.
C. 
When a sixth or subsequent false alarm from the same alarm device occurs, the City of Greensburg, within 15 days from the date of each false alarm, shall notify the person in actual physical control of the alarm device from which the alarm(s) emanated that a false alarm charge is due and the amount thereof. Such notice shall be in writing and mailed to the person in actual physical control of the alarm device at his last known address by regular mail.
D. 
Failure of the City of Greensburg to mail notices required under this section within 15 days from the occurrence of a false alarm shall preclude the City of Greensburg from assessing a false alarm charge for said false alarms.
E. 
A false alarm charge shall be due and payable at the office of the City of Greensburg Police Department 10 days from the date of the mailing of the notice of assessment of a false alarm charge.
F. 
Failure of a person in actual physical control of an alarm device to pay a false alarm charge on or before the due date shall subject such person to summary prosecution before a member of the minor judiciary or District Justice.
Any person who has committed an unlawful act under § 92-6 of this chapter shall, upon conviction, be subject to a fine not to exceed the amount of assessment set forth in § 92-6A of this chapter. Such fines shall be in addition to any court costs or fees imposed by the District Justice.
