It is hereby declared to be a nuisance and it
shall be unlawful for any person, firm or corporation to make, cause,
or permit construction, reconstruction, additions, alterations, demolitions,
site improvements or road work for developments within prohibited
hours of operation.

Operating or permitting the operation of any
equipment or tools in new construction, reconstruction, additions,
alterations, demolition, drilling, excavation, earth moving and paving
will be permitted Monday through Friday between the hours of 7:00
a.m. and 8:00 p.m., and Saturday and Sunday between the hours of 8:00
a.m. and 6:00 p.m. Any work, as referenced above, performed outside
of these hours will be considered a violation of this chapter.
A.
The operation of domestic power tools, to include
but not be limited to a gas powered saw, lawn or garden tools or similar
devices used for the purpose of personal property maintenance, shall
be exempt from this chapter.
B.
The operation of tools or equipment for emergency
work, as determined by the Township's Code Enforcement Officer, shall
be exempt from this chapter.
C.
The construction, reconstruction and maintenance of
the roadways within Limerick Township shall be exempt from this chapter.
D.
The operation
of tools, to include but not be limited to gas-powered lawn or garden
tools or similar devices used for the purpose of mowing a golf course
within Limerick Township, shall be exempt from this chapter.

The compliance monitoring of this chapter shall
be upon receipt of a written complaint.
All complaints of violations of the terms of
this chapter shall be submitted in writing to the Limerick Township
Police Department and must include a narrative description of the
location of the property and the nature of the violation, to include
the date and time of the violation.
It shall be the duty of the Limerick Township
Police Department to enforce this chapter.
Any person who violates any provision of this
chapter, upon conviction thereof in an action brought before a Magisterial
District Judge in a manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $600 plus costs or such
other penalty as may be authorized and imposed by law. Further, in
default of payment thereof, the person shall be imprisoned for a period
not to exceed 30 days. Each day that a violation of this chapter continues
shall constitute a separate offense. Notwithstanding the same, the
Township may seek enforcement by means of a request for injunctive
relief or other equitable remedies as may be provided by law in a
court of competent jurisdiction.
