This chapter shall apply to all territory embraced within the corporate
limits of the Township of Limerick and the area of police jurisdiction thereof,
as now established or as may hereafter be established.
The maintenance of health and sanitation require, and it is the intention
hereof, to make the collection, removal and disposal of garbage, refuse and
dead animals within the Township of Limerick compulsory and universal.
Any person, firm or corporation, except a licensed collector, who shall
violate any provision of this chapter shall, upon conviction thereof, be sentenced
to a fine of not more than $500 and/or imprisonment for a term not to exceed
90 days.
In the event that a person has violated any provision of this chapter
and the Township has expended sums of money in order to correct or remedy
the violation, the Township shall be permitted to recover from the violator,
through any enforcement proceeding, the sums expended for remedying the violation.
If any sentence, clause, section or part of this chapter is, for any
reason, found to be unconstitutional, illegal or invalid, such unconstitutionality,
illegality or invalidity shall not affect or impair any of the remaining provisions,
sentences, clauses, sections or parts of this chapter. It is hereby declared
as the intent of the Limerick Township Board of Supervisors that this chapter
would have been adopted had such unconstitutional, illegal or invalid sentence,
clause, section or part thereof not been included herein.
