This chapter shall apply to all territory embraced within the corporate limits of the Township of Limerick and the area of police jurisdiction thereof, as now established or as may hereafter be established.
The maintenance of health and sanitation require, and it is the intention hereof, to make the collection, removal and disposal of garbage, refuse and dead animals within the Township of Limerick compulsory and universal.
A. 
As used in this chapter, the following terms shall have the meanings indicated:
ASHES
Includes the solid waste products of coal, wood and other fuels used for heating and cooking.
GARBAGE
Includes all putrescible wastes, except sewage and body wastes, including vegetable and animal offal and carcasses of dead animals, but not including recognized industrial by-products.
PERSON
Every person, firm, copartnership, association, corporation, estate or trust.
REFUSE
Includes garbage, rubbish, ashes, swill and all other putrescible and nonputrescible wastes, except sewage.
RUBBISH
Includes all nonputrescible wastes, except ashes.
SWILL
Includes every refuse accumulation of animal, fruit or vegetable matter, liquid or otherwise, that attends the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit and vegetables.
TOWNSHIP MANAGER
The official Township Manager of the Township of Limerick.

Words herein used in the plural shall include the singular, and in the singular shall include the plural; words herein used in the present tense shall include the future tense; and in the masculine shall include the feminine and neuter genders.
A. 
The Township Manager shall be authorized to prepare any rules and regulations for the efficient administration and enforcement of the provisions of this chapter. Such rules and regulations, when approved by resolution of the Board of Supervisors and published, shall become and are hereby made a part of this chapter and any person violating any one of such rules shall be punished as for a violation of this chapter.
B. 
The Township Manager may designate the Code Enforcement Officer to specifically enforce the provisions of this chapter.
A. 
It shall be the duty of every person occupying, in possession, charge or control of any dwelling, flat, rooming house, apartment house, hospital, school, hotel, club, restaurant, boardinghouse or eating place or occupying, in possession, charge or control of any shop, place of business or manufacturing establishment where garbage, refuse or swill is created or accumulated, at all times, to keep or cause to be kept portable appurtenances, metal or other approved cans or containers, of approved size and/or capacity, for the deposit therein of garbage and refuse and to deposit or cause to be deposited the same therein.
B. 
It shall be the duty of the producer (user) to furnish or to arrange for the procurement of a container or containers, as herein designated. Such containers shall be constructed in such a manner as to be strong, watertight, not easily corrodible, rodentproof, insectproof, of not more than 20 gallons' capacity and have tight-fitting lids, except as otherwise authorized by the provisions of this section. Such lids shall not be removed, except when necessary to place garbage and refuse in such containers or to take the same therefrom. Such containers shall be kept in a sanitary condition with the outside thereof clean and free from accumulative grease and decomposing material, and this responsibility shall be that of the producer, except where otherwise provided by regulations adopted by the Township Manager. Each container shall be kept in a place accessible to the collector at ground level or as otherwise approved by the Township Manager.
C. 
Each garbage container shall be kept clean inside and out so that no odor nuisance shall exist. The collector shall place tags on garbage containers found to be in violation of this section and notify the Township Manager. Two or more violations of this provision by persons shall subject the persons to penalties as hereinafter set forth.
D. 
Large suitable containers for both collection of garbage and refuse may, with the approval of the Township Manager, be used by hotels, restaurants, boardinghouses, eating places, apartment houses, schools and hospitals.
E. 
Specially manufactured wet-strength paper bags, designed to be used as refuse containers with a capacity of not more than 30 gallons, may be used for refuse containers, provided that said paper bags are secured by a holder equipped with a tight-fitting lid. If stored outside a building, said paper bags and holders must be enclosed or protected by wire mesh to prevent animals from tearing the paper bags.
F. 
It shall be the duty of the person in possession, charge or control of any dead animal or upon whose premises the same may be located forthwith to cause the same to be removed and disposed of by the Code Enforcement Officer or by procuring proper authorization from the Township Manager.
A. 
It shall be unlawful for any person to bury, burn, dump, collect, remove or in any other manner dispose of garbage or swill upon any street, alley, public place or private property within the Township of Limerick, otherwise than as herein provided.
B. 
It shall be unlawful for any person to bury, burn or dump wastepaper, boxes, rubbish and debris, grass, leaves, weeds and cuttings from trees, lawns, shrubs and gardens, upon any street, alley or public place, or to collect or remove the same over any public right-of-way of the Township of Limerick, except as to wastepaper and box collectors, who shall be duly authorized and licensed by the Township.
Any person, firm or corporation, except a licensed collector, who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to a fine of not more than $500 and/or imprisonment for a term not to exceed 90 days.
In the event that a person has violated any provision of this chapter and the Township has expended sums of money in order to correct or remedy the violation, the Township shall be permitted to recover from the violator, through any enforcement proceeding, the sums expended for remedying the violation.
If any sentence, clause, section or part of this chapter is, for any reason, found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter. It is hereby declared as the intent of the Limerick Township Board of Supervisors that this chapter would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
