An assessment is hereby levied and established for the maintenance of electric streetlighting in Limerick Township, Montgomery County, Pennsylvania, upon all property fronting on a street or highway or portion thereof, illuminated by such streetlights pursuant to the terms of a contract between the Township and PECO, and located within 500 feet of such lighting, whether such property is vacant or improved.
The amount of the assessment imposed hereby shall be based upon a uniform annual assessment of each property benefited which is an equitable means of assessment as determined by the Township Supervisors. The amount of the assessment imposed hereby will be calculated based upon the following formula: The amount of each assessment here imposed will be based upon the amount due PECO for a twelve-month period, plus administration and collection costs, divided by the total number of benefited properties.
The Township Tax Collector shall give written or printed notice to all persons liable for payment of the assessment imposed hereby that the same is due and payable and shall collect the assessment in the same manner as the tax levied by the Township upon real property. Every person subject to the assessment imposed hereby shall make payment of the whole amount due within 30 days after receipt of the written or printed notice. Every person subject to the assessment imposed who fails to make payment of the whole amount thereof within 30 days after the date of the notice shall be subject to a penalty of 10% of the amount of the assessment due and, in addition, shall pay interest at a rate of 1.5% per month or fraction of part of a month, computed upon the amount of the assessment due until the date of payment thereof.
This article shall not apply to any person or property to whom or which it is beyond the legal power of the Township of Limerick to impose the assessment herein provided.
The Township reserves a right to adopt, from time to time, additional rules and regulations as it shall deem necessary and proper relating to the administration of this article.
