In interpreting and applying the provisions of this chapter, said provisions shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare. Where the provisions of this chapter impose greater restrictions than those of any statute, other ordinance or regulation, the provisions of this chapter shall be controlling. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than this chapter, the provisions of such statute, other ordinance or regulation shall be controlling.
A. 
Unless otherwise expressly stated, the following words and phrases shall be construed throughout this chapter to have the meanings herein indicated:
PERSON
Includes any person, partnership, association or private corporation, whether the same be an owner of real estate, lessee or tenant, general agent, special agent or independent contractor.
WELL
A hole or shaft sunk into the earth, customarily utilized to withdraw or obtain a fluid from a subterranean supply.
B. 
The singular shall include the plural, and the plural shall include the singular. The word "shall" is always mandatory.
It shall be unlawful and in violation of this chapter for any person to drill, dig, construct or utilize a well, except in conformity with the provisions of this chapter.
No well shall be drilled, dug, constructed or used for any purpose whatsoever except the withdrawal of fluids from subterranean sources. The discharge of sewage or any substance into a well is expressly prohibited.

It shall be unlawful and in violation of this chapter for any person to drill, dig or construct a well in the Township without having first registered with the Township Manager. Such registration will be deemed completed after submission of a written request, along with a registration fee, and the issuance of a statement of registration by the Township Manager.
The registration provided for in § 181-5 hereof shall be perpetual unless revoked for cause by the Township. Such registration will be automatically revoked upon conviction or judicial decision that the registrant has violated any terms of this chapter.

No well may be drilled, dug or constructed nor shall any well drilled after the effective date of this chapter be utilized without having first received a well permit from the Code Enforcement Officer. Applications for permits shall be submitted to the Code Enforcement Officer, along with the application fee.
The registration and application fees herein provided may be increased or decreased or entirely eliminated by the Supervisors of Limerick Township at any time by resolution.
A. 
In the case of any violation of this chapter, the Township Supervisors, in addition to other remedies, may institute in the name of the Township any appropriate action or proceedings to prevent such violation or to restrain, correct or abate such violation.
B. 
For any and every violation of the provisions of this chapter, any person who knowingly commits, takes part in or assists in any such violation shall be liable, on conviction thereof, to a fine of not less than $25 nor more than $1,000 plus costs of prosecution and, in default of payment of such fine and costs, to imprisonment in the Montgomery County Prison for a period not exceeding 30 days; and, whenever such person shall have been notified by the Township that he is committing such violation of this chapter, each day that he shall continue such violation shall constitute a separate offense punishable by a like fine or imprisonment. Such fines shall be collected as like fines are now collected by law.
