This chapter shall be cited as the "Woodcliff
Lake Gold, Silver and Jewelry Dealers Ordinance."
For the purpose of this chapter, the following
words are defined as follows:
DEALER
Any person, partnership, corporation or other business entity
who, through any means, buys or sells secondhand gold, silver, precious
metals or jewelry.
MINOR
Any person under the age of 18 years.
No person shall buy, sell or dispose of secondhand
gold, silver, precious metals or jewelry within the Borough of Woodcliff
Lake without first obtaining a license therefor.
Any person desiring a license under §
261-3 of this chapter shall file with the Borough Clerk an application on a form supplied by the Borough Clerk. The application shall be in duplicate and shall be sworn to by the applicant. The application shall contain the following information:
A. The name and permanent address of the applicant.
B. If the applicant is a corporation, partnership or
other business entity, the names and addresses of each person having
more than a ten-percent interest in the applicant.
C. The address of the applicant's place of business within
the Borough of Woodcliff Lake and any other business locations of
the applicant.
Upon receipt of an application for a license,
the Borough Clerk shall forward a copy of the application to the Chief
of Police, who shall register the applicant with the Woodcliff Lake
Police Department.
All licenses shall be issued for the period
of January 1 through December 31 of each year.

The applicant shall pay an annual fee as provided in Chapter
163, Fees.
Each dealer shall maintain a complete record
of each purchase and sale, including the amount paid, the name, residence,
occupation, age and description of the person from whom any item was
purchased, received or sold.
The record of transactions required in §
261-8 shall be open to inspection by any member of the Woodcliff Lake Police Department or other persons authorized by the Woodcliff Lake Chief of Police.
Each licensed dealer shall deliver to the Woodcliff
Lake Chief of Police a detailed description of all items purchased,
received or sold within 72 hours of such purchase, receipt or sale
on forms provided by the Chief of Police.
Each dealer or other person shall require accurate
identification of the person with whom he is transacting business
subject to this chapter.

Any person who violates any provision of this
chapter shall, upon conviction thereof, be subject to a fine of not
more than $1,000 or imprisonment for not more than 90 days, or both,
in the discretion of the court.
