A. 
All ashes, garbage and rubbish accumulating on any premises within the Borough of Wanaque shall be removed as hereinafter provided, at the general expense of the Borough of Wanaque.
B. 
Each and every owner, tenant, lessee, housekeeper, caretaker and other person or persons occupying any dwelling house or other building or portion thereof in the Borough of Wanaque, County of Passaic and State of New Jersey, wherein ashes, garbage and rubbish accumulate, is hereby required to collect and separate the said refuse materials accumulating in any such dwelling house or building or portion thereof occupied by such person or persons, respectively, into three classes, as follows:
(1) 
The word "ashes" will constitute one separate class, and means residue from coal, wood, coke or other fuel consumed.
(2) 
The word "garbage" shall constitute one class, and means the refuse of animal or vegetable matter which has been used or intended as food for man or beast in the ordinary conduct of the household.
(3) 
The word "rubbish" shall constitute a third distinct class of refuse matter. It shall include all miscellaneous matter, such as discarded paper, cardboard, old shoes, carpets, bottles, tin cans, broken glass, crockery, worn-out furniture, mattresses, old clothes, rags, excelsior and all other waste material not elsewhere defined herein.
C. 
This chapter shall not apply to any collection of earth, stone, plaster, wood or other material from excavating for or from constructing, altering or repairing any building.
All ashes, garbage and rubbish shall be removed under the direction of the Board of Health of the Borough of Wanaque, County of Passaic and State of New Jersey, subject to such additional rules and regulations as said Board shall, from time to time, prescribe by resolution not inconsistent with this chapter.
A. 
Each and every owner, tenant, lessee, housekeeper, caretaker and other person or persons occupying any dwelling house or other building or portion thereof in the Borough of Wanaque, County of Passaic and State of New Jersey, in which ashes, garbage and rubbish accumulate, shall provide suitable receptacles as prescribed below, in which the occupant shall place and keep separately the various accumulations of refuse. In no case shall it be allowed to mix rubbish or garbage with ashes.
B. 
The collector or scavenger shall not accept for removal any ashes or rubbish when mingled with garbage in the same receptacle, but, upon finding such mingled waste, shall report this situation to the Board of Health of said Borough of Wanaque.
A. 
The garbage receptacles shall be strong, watertight, galvanized iron pails or plastic pails, to hold not less than 2 1/2 gallons and no more than 10 gallons, with closely fitting metal covers which shall be kept in place.
B. 
The receptacles for ashes shall be boxes, cans or small barrels that can be handled by one man, of a size to hold not more than 100 pounds of coal ashes.
C. 
The receptacles for rubbish other than paper shall be substantial, tight containers, preferably of metal, but also may be strong boxes, baskets or barrels where the character of the rubbish is such as to be capable of being placed in such receptacles and so constructed as to prevent spilling or leakage of the contents. They shall not be filled higher than three inches below the top of the container.
D. 
Where, however, the rubbish material is of such a nature that it cannot be deposited in a container, it must be securely bundled in such a manner as to permit easy handling and to prevent the contents of the same from being scattered.
E. 
The receptacles, containers or bundles shall be placed by the owner, tenant, lessee, housekeeper, caretaker and other person or persons occupying any dwelling house or other building, or portion thereof, on the sidewalk in front of said premises near the curb where the same shall be easily accessible to the collectors.
F. 
Each and every owner, tenant, lessee, housekeeper, caretaker and any other person occupying any dwelling house or portion thereof or other building or structure, whether business, commercial, industrial, residential or mixed, shall not deposit or cause to be deposited recyclable items, garbage or garbage containers for collection before 6:00 p.m. the night before collection. Empty garbage containers or uncollected garbage or recyclable items not collected must be removed from the collection area by 6:00 p.m. of the day of collection.

G. 
Collections shall be made on such days, in such manner and under such additional rules and regulations not inconsistent with this chapter, as may hereinafter be fixed and determined by resolution.
H. 
After the receptacles are properly emptied, the collector shall return them to the point or place from which he took them.
I. 
Each and every owner, tenant, lessee, housekeeper, caretaker and any other person occupying any dwelling house or portion thereof or other building or structure, whether business, commercial, industrial, residential or mixed, shall, both prior to and after collection, place or store garbage containers, garbage and recyclables a reasonable distance from the sidewalk or roadway until the next scheduled collection. In determining what is a reasonable distance, regard will be had to the nature and quality of the neighborhood, zone and the setback requirements relating thereto, easements, rights-of-way, buffer zones and environmentally sensitive areas.

J. 
Sprinkling of garbage with disinfectant or poisonous chemical is prohibited within the limits of the Borough of Wanaque.
A. 
The Borough of Wanaque shall provide a suitable place or places for the disposing of all ashes, garbage and rubbish, and the collector shall there dispose of the same.
B. 
No ashes, garbage, rubbish or other refuse shall be placed or deposited in any place in the Borough of Wanaque other than in the duly designated depository provided by the Borough of Wanaque for such purposes.
During the month of May in each year, one week shall be designated by the said Board of Health of the Borough of Wanaque as "cleanup week," during which the collector shall remove, from the curb of the premises covered by this chapter all rubbish and other material offered for collection, no single piece to weigh more than 100 pounds. No extra compensation shall be asked or claimed by the collector either from the Borough or from the occupant for such "cleanup week" collections.
A. 
No person, firm or corporation other than the person, firm or corporation to whom a contract has been or may be awarded by the Mayor and Council of the Borough of Wanaque for the collection of garbage, together with his agents and servants, shall take or remove or cause to be removed any articles whatsoever, from any can, barrel, bag, basket or any other type of receptacle or container, ashes, garbage or rubbish.
B. 
No person, firm or corporation other than the person, firm or corporation to whom a contract has been or may be awarded by the Mayor and Council of the Borough of Wanaque for the collection of garbage, together with his agents and servants, shall carry away or cause to be carried away and discarded goods, paper, garbage or rubbish or any article whatsoever which has been placed at the curb for the purpose of being taken up by the collectors of garbage who are fully authorized to do so as hereinbefore set forth.
Any person guilty of any violation of any of the provisions of this chapter shall, upon conviction thereof, be subject to a penalty of not more than $500 nor less than $5 for each offense.
