No person or persons shall create any unreasonably loud, disturbing
or unnecessary noise or permit such noise to be created by a third
party upon property which is within their ownership and control.
The following acts, among others, are declared to be disturbing
and unnecessary noises in violation of this chapter, but such enumeration
shall not be deemed to be exclusive:
A. The sounding of any horn or signal device on any automobile, bus
or other vehicle, except as a danger signal or other warning signal.
B. The playing of any radio, phonograph, amplifying device or any musical
instrument in such manner or with such volume, particularly during
the hours between 9:00 p.m. and 7:00 a.m. prevailing time, as to annoy
or disturb the quiet, comfort or repose of persons in any dwelling,
apartment or other type of residence.
C. The keeping of any animal or bird which, by frequent long continued
noise, shall disturb the peace, quiet, comfort or repose of any person
in the vicinity.
D. The use of any automobile, motorcycle or vehicle so out of repair,
so loaded or in such manner as to create loud or unnecessary grating,
grinding, rattling, engine or other noise.
E. The discharge into the open air of the exhaust of any automobile,
motorcycles or other engine, except through a muffler or other device
which effectively prevents loud or explosive noises therefrom.
F. For advertising purposes or for the purpose of attracting the attention
of the passing public, to play, use, operate or permit to be played,
used or operated any radio receiving set, musical instrument, phonograph,
loudspeaker, sound amplifier or other machine or device for the producing
or reproducing of sound on streets or public places or in any place
where the sound therefrom is cast directly upon the streets or public
places or which is so placed and operated that the sound therefrom
can be heard to the annoyance or inconvenience of travelers upon any
street or public place or of persons in neighboring premises.
G. Construction or repairing of buildings. The erection (including excavating),
demolition, alteration or repair of any building other than between
the hours of 7:00 a.m. and 6:00 p.m. on weekdays and 8:00 a.m. and
5:00 p.m. on Saturdays, except those days which are designated as
any of the following holidays: New Year's Day, Memorial Day,
Independence Day, Thanksgiving Day and Christmas Day, except in case
of emergency requiring such activity in the interest of public health,
safety and welfare, and then only with a permit from the Construction
Code Official, or in cases where the governing body has determined
that the proposed activity will not be disturbing to any member of
the public as the result of the creation of noise, and in such cases
only under a permit from the Construction Code Official issued with
the advice and consent of the governing body.

H. Lawn mowers/blowers. The use of powered lawn mowers and/or blowers
between the hours of 7:00 p.m. and 7:00 a.m. Monday through Friday;
6:00 p.m. Friday and 9:00 a.m. Saturday; 5:00 p.m. Saturday through
9:00 a.m. Sunday; Sunday 5:00 p.m. through Monday 7:00 a.m. Snow blowers
are exempted from this subsection.

Any person violating any provisions of this chapter shall, upon
conviction, be punishable by one or more of the following: a fine
of not more than $2,000, imprisonment for not more than 90 days, or
a period of community service not to exceed 90 days, in the discretion
of the court. Each day a violation continues shall be considered a
separate offense.
