GENERAL REFERENCES

It is the intent of this chapter to allow the Village of Floral
Park to make procurements under § 103, Subdivision 16, of
the General Municipal Law through the use of contracts let on the
basis of either the "lowest responsible bidder" or "best value."
This chapter is adopted pursuant to Subdivision 16 of General
Municipal Law § 103, which was added to the statute by the
Legislature in 2013 so as to allow municipalities to make procurements
on the basis of "best value," in addition to the existing "lowest
responsible bidder" standard.
This Board of Trustees of the Village of Floral Park, County
of Nassau, is hereby authorized to let contracts on the basis of "best
value."
If a court determines that any clause, sentence, paragraph,
subdivision, or part of this chapter or the application thereof to
any person, firm or corporation, or circumstance is invalid or unconstitutional,
the court's order or judgment shall not affect, impair, or invalidate
the remainder of this chapter, but shall be confined in its operation
to the clause, sentence, paragraph, subdivision, or part of this chapter
or in its application to the person, individual, firm or corporation
or circumstance, directly involved in the controversy in which such
judgment or order shall be rendered.
This chapter shall take effect immediately upon filing with
the Secretary of State.
