This chapter is enacted in accordance with a policy requirement of the Division of Criminal Justice Services of the State of New York as a prerequisite for the Police Department of the Incorporated Village of Floral Park to apply for and obtain criminal history records of applicants for employment with the Village of Floral Park, for membership in the Volunteer Fire Department and Auxiliary Police, for licenses relating to hawking and peddling, operating taxicabs or tow cars and other activities requiring an investigation of the applicant before a license is issued.
In order to determine the kind of past conduct which would preclude any applicant from employment with the Village of Floral Park, from membership in the Volunteer Fire Department and Auxiliary Police, and from obtaining a license, the following criteria shall aid in such determination:
A. 
Where an applicant has been convicted of any offense against any of the laws, ordinances, rules or regulations of the State of New York, or of any municipality therein.
B. 
Where an applicant has been found by any court of the State of New York to have practiced any fraud, deceit or misrepresentation in the conduct of any occupation, business or profession.
C. 
Where an applicant has had his or her license, which was duly issued under any of the chapters herein, revoked at any time during the year prior to the time of an application for renewal thereof.
D. 
Where an applicant has had his or her license, which was duly issued under any of the chapters herein, suspended and the period of such suspension has not expired at the time of the application for such license.
E. 
If an applicant has been convicted of any such offense, any decision regarding such applicant's fitness for a license or employment must be made upon consideration of New York State Correction Law §§ 701 through 703-b and §§ 751 through 753.
The applicant shall submit his or her fingerprints and any required fees through a method approved by the New York State Division of Criminal Justice Services for full search and retain processing. The Village Clerk shall reimburse Volunteer Fire Department and Auxiliary Police applicants for the required cost in the securing and searching of the applicant's criminal history record.
This chapter shall become effective immediately.
