A. 
No person, firm, association or corporation shall conduct, run or operate or permit to be conducted, run or operated, any hotel, restaurant, eating place, lunch counter or place for the sale of food or beverages of any class or description to be eaten or consumed on the premises in the Village of Floral Park without a license therefor as hereinafter provided.
B. 
Any person, firm, association or corporation which shall hereafter desire to conduct, run or operate or permit to be conducted, run or operated a hotel, restaurant, eating place, lunch counter or place for the sale of food or beverages of any class or description to be eaten or consumed on the premises, shall apply in writing to the Board of Trustees for the issuance of a license therefor, which application shall state in detail the name of the person or persons, firm, association or corporation owning, leasing, managing or proposing to conduct or operate such hotel, restaurant, eating place, lunch counter or place for the sale of food or beverages for which a license is desired, the place of residence of such person or persons or the residence of the person or persons composing any such firm or association, and the principal place of business of any such corporation, the name of the officer in case of a corporation upon whom process or other legal notice may be served within the village, the location within the village of the building wherein the same is to be located and the nature of the business which it is desired to conduct or operate.
C. 
Upon receipt of any such application, the Village Clerk shall refer the same to the County Health Officer for investigation and report as to the sanitary conditions of such hotel, restaurant, eating place, lunch counter or place for the sale of food and beverages. The County Health Officer shall hereupon inspect the premises on which such business is operated and report the results of his investigation to the Board of Trustees.
D. 
If the County Health Officer shall report that his inspection shows that said premises are maintained in a sanitary condition, the Board of Trustees may authorize the Village Clerk to issue such license to the applicant therefor upon the payment of a license fee of $10 per annum.
E. 
The Village Clerk is hereby authorized to suspend any license in the event that the County Health Officer shall at any time report that he has inspected said premises and found the same to be in unsanitary condition until the next meeting of the Board of Trustees and thereat the said license may be revoked or continued by the Board of Trustees at its discretion.
A. 
Buildings including floors, tables, counters and surroundings must at all times be kept scrupulously clean.
B. 
No food or drink shall be sold or exposed for sale unless it is covered in such a manner that it is protected from flies and dust.
C. 
Ice cream, not sold in bricks or cones, will be sold in dishes which have been cleansed in boiling water. If cones are used the will be kept covered until used.
D. 
No food or drink shall be sold or offered for sale or dispensed in dishes which have been previously used unless the said dishes have been adequately cleansed with boiling water. Dishes cracked or chipped shall not be used.
E. 
All garbage will be kept covered and removed daily. No accumulation of waste paper or other rubbish will be permitted to accumulate in buildings or surroundings. All empty bottles will be kept covered until removed.

Any person violating any provision of this chapter shall be liable for and forfeit and pay a penalty as provided in § 32-13 of chapter 32 hereof. Said violation shall constitute and is hereby declared to be disorderly conduct, and any person violating this chapter or any provision thereof shall be and hereby is declared a disorderly person as provided in § 32-1 of Chapter 32 hereof.
