To set forth rules and regulations of owners of registered motor
vehicles using the Village of Boonville Municipal Parking Lots A and
B.
As used in this chapter, the following terms shall have the
meanings indicated:
OWNER
Any person who is the private owner of a registered or unregistered
motor vehicle and/or any person who is an employee, servant, and/or
agent having the use and control of any registered motor vehicle.
REGISTERED MOTOR VEHICLE
Any motorized vehicle that is registered by the Department
of Motor Vehicles of the State of New York, or any other state of
the United States.
No owner or person shall park any vehicle overnight in parking
lot A, as designated on the Boonville municipal parking lot map.
No owner or person shall park any vehicle overnight in parking
lot B, as designated on the Village of Boonville Municipal Parking
Lot Map, without a permit issued by the Village Clerk's Office.
Said permits will be issued on a first-come-first-served basis in
an area designated in parking lot B, located on the easterly side
of said parking lot, commencing at the rear of the Boonville Graphics
building (so-called) in a straight line southerly to Church Street,
with the exception that there is no parking allowed in the underpass
crosswalk area. The Boonville Fire Department will have 10 parking
spaces designated on the southerly side of parking lot B, without
permits.
Parking is prohibited in parking lots A and B in spaces designated
by proper signs as handicapped parking spaces, except by vehicles
registered pursuant to § 1203-a of the New York State Vehicle
and Traffic Law.
Special users of parking lots A and B must receive a permit
from the Village Clerk's office.
The speed limitation for both parking lots A and B is five miles
per hour.
In all parking spaces, vehicles will be parked completely within
the painted stall lines, all vehicles parking the same.

Every owner found in violation of this chapter, and a notice
and/or traffic ticket was attached or affixed to said vehicle, shall
pay to the Boonville Town Justice as penalty for, in full satisfaction
of, the amount of $15. Any accrued fines not paid within 20 days of
the date of violation shall be raised to $25; for each delinquent
notice or traffic ticket unpaid after 30 days of such notice, the
amount of $30 shall be charged.
After the removal of any vehicle as provided in this chapter,
the Boonville Village officer in charge of the Police Department may
store or cause such vehicle to be stored in a suitable place at the
expense of the owner. Such owner, or person in charge of the vehicle,
may redeem said vehicle upon payment, to the person in charge, of
the amount of all expenses actually and necessarily incurred in effecting
such removal and storage. Such storage charges shall not exceed $15
per day or a fraction thereof.
It shall be the duty of the Boonville Village officer in charge
of the Police Department to ascertain, to the extent possible, the
owner of the vehicle or the person having the same in charge and to
notify him/her of the removal and disposition of said vehicle and
of the amount required to redeem same. Said Boonville Village officer
in charge of the Police Department shall also, without delay, report
the removal and disposition of any vehicle removed as provided in
this section to the Boonville Village Clerk's office.
All registered motorized vehicles may use parking lots A and
B, provided they are not a tractor with trailer, a private vehicle
with trailer, buses that carry more than eight passengers, dump trucks,
and motorized construction equipment, except for trucks making deliveries
to the merchants and private homeowners around the parking lot, and
for maintenance and repair of all buildings in the area of the parking
lot itself. All registered motor vehicles that are used for delivery,
loading and unloading merchandise, goods and services, and construction
and maintenance are permitted.
The Village of Boonville Street Superintendent may post various
streets and parking lots for alternate parking during the removal
of snow and ice and further post the same streets and parking lots
during floods, fires, or other public emergencies.
