A.
It is the intent of the Board of Trustees of the Village of Boonville
to abolish and terminate the Village of Boonville Court System, and
the Village of Boonville Justice and the Village of Boonville Associate
Justice positions, pursuant to its authority under Village Law §§ 3-301
and 3-302. It is the intent of the Board of Trustees of the Village
of Boonville to immediately terminate the Court System, Village Justice
and Associate Justice positions upon the expiration of the current
term.
B.
On April 1, 2018, the Village of Boonville Court would cease to exist
and the Village Justice, Associate Village Justice, Village Court
Clerk and all supportive services would terminate.
On or after April 1, 2018, all matters necessitating the intervention
of the local justice court system, both criminal and civil actions,
originating in the Village of Boonville or once adjudicated in the
Boonville Village Court System shall be docketed in the Town of Boonville
Justice Court.
If a court determines that any clause, sentence, paragraph,
subdivision, or part of this chapter or the application thereof to
any person, firm or corporation, or circumstance is invalid or unconstitutional,
the court's order or judgment shall not affect, impair, or invalidate
the remainder of this chapter, but shall be confined in its operation
to the clause, sentence, paragraph, subdivision, or part of this chapter
or in its application to the person, individual, firm or corporation
or circumstance directly involved in the controversy in which such
judgment or order shall be rendered.
Within five days of the effective date of this chapter, the
Board of Trustees of the Village of Boonville shall file a copy of
this chapter with the Clerk of the Town of Boonville and with the
State Office of Court Administration.
