The boundary lines of the Borough of Souderton are hereby established as a zone in which motor vehicles may remain standing without lights, and all streets within such boundary limits are hereby designated as highways where motor vehicles may remain standing without lights, provided that they are legally parked.

A. 
No tractor or combination of tractor and trailer, bus, mobile home, motor home, recreational vehicle, motorless vehicle, trailer or similar vehicle shall be parked on any public street, alley, or public parking lot of the Borough of Souderton between the hours of 12:00 midnight and 6:00 a.m., prevailing time, for more than three consecutive nights within a period of 90 days.
B. 
No construction vehicle, construction equipment or construction trailer; no refuse container, dumpster or similar devise used for the collection and/or transport of refuse, debris or construction materials shall be parked or placed on any public street, sidewalk, alley or public parking lot of the Borough of Souderton unless a permit therefor shall have been issued by the Chief of Police following the filing and approval of an application. The application and permit shall indicate the location and length of time required for the placement of the vehicle or container. Failure to obtain or comply with the terms of a permit shall constitute a violation of this subsection. The issuance of a special permit shall require the payment of a permit fee to be established from time to time by the Borough. The Police Department of the Borough of Souderton is authorized to remove any vehicle, equipment or container found to be in violation of this subsection at the expense of the owner.
Whenever a space shall be marked off on a highway, alley or public parking area for the parking of an individual vehicle, every vehicle there parked shall be parked wholly within the lines bounding such space.
Parking shall be prohibited at all times at the following locations:
A. 
In front of the entrance to any theater, firehouse, church, school or other place of assembly, when such prohibition shall be authorized by the Council and official signs giving proper notice thereof have been erected at such locations.
B. 
In any area prohibited for parking use by signs thereon erected or by yellow or white paint placed upon the adjacent curbs.

(2) 
Exemption for vehicles displaying valid parking permits. Any motor vehicle displaying a valid parking permit issued pursuant to Subsection E(3) hereunder shall be exempt from enforcement of Subsection E(1) and shall be permitted to park in the aforementioned two-hour parking zone during hours when parking is limited to two hours for a time period in excess of the two-hour parking limit unless otherwise restricted. Parking permit holders must comply with all other parking regulations in effect.
(3) 
Application for issuance of permit. Applications for a parking permit shall be made by the person desiring the permit who resides in a property in the designated permit parking district. A separate application shall be made for each motor vehicle. The application shall be on a form prescribed by Borough Council and shall contain the following information: the name of the owner or lessee of the vehicle; the address of the owner or lessee; and the make, model and registration number of the vehicle. The Chief of Police shall verify the information by examination of the applicant's vehicle registration, lease agreement and operator's license.
(4) 
Issuance of permit. Upon receipt of the completed and verified application and upon determination by the Chief of Police that the information on the application demonstrates that the applicant is entitled to a parking permit, the Chief of Police shall issue to the applicant a numbered residential parking permit for the particular motor vehicle described in the application. The permit shall not be transferrable from one vehicle to another, except that a temporary permit may be issued when requested by a resident for use on a rental or loaner vehicle being used in lieu of the permitted vehicle when disabled or while being repaired. Temporary permits shall bear the very same permit number as that of the disabled vehicle.
(5) 
Responsibility of permit holder. Parking permits shall be displayed on the vehicle to which the permit pertains in a clearly visible location as determined by the Chief of Police. A residential parking permit shall not guarantee or reserve to the holder a parking space in front of or near to the holder's residence. Parking permits shall not authorize the operator of the vehicle to which it pertains to stand or park a motor vehicle in any place or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulations other than as specifically set forth in this subsection.
(6) 
Violations.
(a) 
It shall constitute a violation of this Subsection E to display a permit upon any vehicle other than the vehicle to which such permit pertains.
(b) 
It shall also constitute a violation of this Subsection E for any person to falsely represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit. The Chief of Police shall have the authority to revoke a parking permit found to be in violation of any provision of this Subsection E. Upon written notification of the revocation, the permit holder shall surrender the permit to the Chief of Police, and failure to so surrender shall constitute a violation of this Subsection E.

On school days between the hours of 8:15 a.m. and 8:45 a.m., and 3:00 p.m. and 3:30 p.m., parking shall be limited to school buses for purposes of loading and unloading at the following locations:

No person shall park a vehicle on the street or alley or public parking lot for the principal purpose of:
A. 
Displaying such vehicle for sale.
B. 
Lubricating, greasing, maintaining or repairing such vehicle, except repairs or maintenance necessitated by an emergency.
No person shall stop or park on any street or alley or public parking lot, except when necessitated by an emergency, any vehicle which cannot be lawfully operated on any public street or highway either as a result of some malfunction, mechanical or other defect of the vehicle, or as a result of the provisions of the Vehicle Code, 1959, April 29, P.L. 58, 2101, as from time to time amended.
