The following acts are hereby declared unlawful and are prohibited:
A. To allow any tree or branch thereof or any shrubbery or other vegetation
to overhang any sidewalk at a height of less than seven feet. If any
tree or branch thereof or any shrub or other vegetation having less
than seven feet clearance above a sidewalk is not removed or trimmed
to conform to the requirements of this subsection by the owner of
the property upon which it is growing, within five days of notice
from the Borough Council so to do, the Borough Council may cause such
tree, branch, shrub or other vegetation to be removed or to be trimmed
to conform to the requirements of this subsection, and the Borough
shall collect the cost of such work of removal and/or trimming from
the owner of such property. Any property owner refusing to pay such
charges and convicted before any District Justice of violating this
subsection shall be sentenced to pay a fine of not more than $25 and
costs of prosecution, or to imprisonment in the county jail for not
more than 10 days, or to both such fine and imprisonment.

B. Littering of newspapers, handbills and other printed material.

(1) The following acts are hereby declared unlawful and are prohibited:
(a)
To throw, drop, place, post, deposit or cause to be thrown,
dropped, placed, posted or deposited, upon any of the streets, alleys,
sidewalks, parks, playgrounds, parking lots or other public places
within the Borough and any structure therein, any newspaper, circular,
poster, handbill or other printed material.
(b)
To throw, drop, place, deposit or cause to be thrown, dropped,
placed or deposited upon any yard, driveway, porch, stoop, private
walkway or any other private place within the Borough any newspaper,
circular, poster, handbill or other printed material unless the same
has been solicited by an owner or occupant of the premises or the
material is contained within an envelope and securely placed on a
porch or stoop so that it will not be carried from the porch or stoop
by the elements.
(2) Any person who shall violate the terms of Subsection
B(1)(a) or
(b) hereof shall, upon conviction thereof, be sentenced to pay a fine not in excess of $600 or to imprisonment for not more than 30 days in the county jail, or to both such fine and imprisonment.
C. To cast, throw or run water on any of the sidewalks or pavements
of the Borough, either for cleaning or washing the same or for any
other purpose, between the 15th day of November and the 15th day of
March of any year, and thereby cause ice to form on such sidewalk
or pavement. Any person convicted thereof before any Magisterial District
Judge shall pay a fine not exceeding $5.
D. To throw or drop or permit to fall upon any of the streets, sidewalks
or public places in the Borough any paper, paper boxes or litter of
any kind or nature, or any banana skin or vegetable matter that is
liable to endanger the safety of persons using such street or sidewalk
or being in any such public place. Any person violating any of the
provisions of this subsection shall, upon conviction thereof before
any Magisterial District Judge, be sentenced to pay a fine of not
more than $10 or to imprisonment in the county jail for not more than
10 days or to both such fine and imprisonment.
