A. 
Subdivisions; selling before approval. Penalties relating to the sale or transfer of any lands involved in a subdivision prior to receipt of final subdivision approval shall be as set forth in N.J.S.A. 40:55D-1 et seq.
B. 
Violation of site plan provisions. Any person violating any of the site plan provisions shall be liable to the penalty stated in § 450-42B.
C. 
Validity of building permits and certificates of occupancy. Any development subject to site plan review regulations shall not be instituted and no building permit issued until final site plan approval has been granted by a duly constituted approving authority. A building permit or certificate of occupancy issued for a development after receipt of final approval by a duly constituted approving authority shall remain valid only so long as the terms and conditions of the final approval are fully complied with. Any such development that violates any of the terms and conditions of site plan approval shall be found by the responsible building official to be in violation of the terms of Chapter 450, Zoning, and shall be subject to all of the remedies and penalties provided for such violation set forth therein.
These rules, regulations and standards shall be considered the minimum requirements for the protection of the public health, safety and welfare of the citizens of the Township. Any action taken by the Planning and Zoning Board under the terms of this chapter shall give primary consideration to the above mentioned matters and to the welfare of the entire community.
The various parts of this chapter, including sections, subsections, sentences, clauses, phrases and words, are separate, and if any part is properly found to be invalid or unconstitutional by a court of competent jurisdiction, such findings shall not affect the remaining portions of this chapter.
