No person shall consume liquor, beer, wine or other alcoholic beverages while such person is on any public highway, public street, public sidewalk, public parking area or in any vehicle, public park or public place, except those premises duly licensed for the sale and consumption of alcoholic beverages on the premises.
The Town Board upon request and for good cause shown may by resolution, at its discretion, permit the drinking of alcoholic beverages at public parks or other places for an authorized function. The resolution shall set forth the hours within which the alcoholic beverages may be consumed.
A violation of this article shall constitute an offense punishable by a fine not exceeding $25 or by imprisonment for 10 days, or by both such fine and imprisonment, for the first offense, and by a fine not exceeding $50 or by imprisonment for a second or subsequent offense.
Should any section or provision of this article be decided by the courts to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof other than the part so decided to be unconstitutional.
The foregoing ordinance shall take effect 10 days after its adoption, publication and posting as provided by law.
