This article be cited as "L.L. No. 1 of 2008 of the Town of Rye."
Residency requirement for the Office of the Town Attorney.
The Town of Rye has established the Office of the Town Attorney pursuant to Town Law § 20, Subdivision 2(a). The Town Board may appoint any attorney licensed to practice law in the State of New York who resides in the County of Westchester, State of New York, as Town Attorney for the Town of Rye.
To the extent that this article conflicts with any of the following New York State statutes, said statutes are hereby modified and superseded by this article: Town Law § 23, Public Officers Law § 3 and Public Officers Law § 30.

This article shall be cited as "Local Law No. 2, Year 2021 of the Town of Rye, Residency Requirement for the Rye Town Justice Court Employees."
The Town of Rye has established certain positions within the Town Justice Court, including but not limited to Town Justice Court Clerks and Town Justice Court Attendants, pursuant to the New York State Civil Service Law. Under this article, the Town Board may, in its discretion, appoint any person, aged 21 or older, who resides in the County of Westchester, State of New York for said Town Justice Court positions.
To the extent that this article conflicts with any of the following New York State statutes, said statutes are hereby modified and superseded by this article: Town Law § 23, Public Officers Law § 3 and Public Officers § 30.
Notwithstanding the provisions of NYS Public Officers Law Article 2, § 3, requiring a person to be a resident of the political subdivision or municipal corporation of the state for which he shall be chosen or within which his official functions are required to be exercised, a person holding the Office of Court Clerk, Assistant Court Clerk or Court Attendant need not be a resident of the Town of Rye.
