This article shall be known and may be cited as "Local Law No. 1, Year 2024" amending the local laws of the Town of Rye, by adding Chapter 54B entitled "Town Clerk" which authorizes the Town Clerk to appoint not more than three Deputy Town Clerks. This article is hereby adopted pursuant to the provisions of § 10 of the NYS Municipal Home Rule Law and § 10 of the NYS Statute of Local Governments. It is the intent of the Town Council pursuant to § 10 of the NYS Municipal Home Rule Law to supersede the provisions of § 30 of the New York State Town Law relating to the number of Deputy Town Clerk appointments the Town Clerk is permitted to make.
A. 
The local laws of the Town of Rye are hereby amended to establish the number of Deputy Town Clerks that may be appointed by the Town Clerk.
B. 
The Town Clerk of the Town of Rye may appoint up to three Deputy Town Clerks to serve at the same time. The position of Deputy Town Clerk shall be funded pursuant to the adoption of the Town Budget, subject to amendment via resolution by the Town Council. The Town Clerk shall have no authority regarding the salary determination for the appointed Deputy Clerks.
C. 
The Deputies of principal executive officers are authorized by law to act generally for and in place of their principals. The Deputy Town Clerks will act generally for and in place of the Town Clerk on all matters.
D. 
This article shall take effect immediately upon filing with the Secretary of State.
