It shall be unlawful for any person to store, sell, offer or expose for sale, or have in his possession with intent to sell, or to use, discharge or cause to be discharged, ignited, fired or otherwise set in action within the limits of the Town of Rye outside the incorporated Villages of Port Chester, Rye[1] and Mamaroneck, any fireworks, firecrackers, rockets, sparklers, torpedoes, Roman candles, fire balloons or other fireworks, or substances of any combination whatsoever, designed or intended for pyrotechnic display. It shall be unlawful for any person to discharge within said portion of the Town of Rye any rifle, gun, pistol, revolver, cane or other appliance, whether projecting or exploding any bullet, cartridge, blank cartridge, cap or otherwise or any explosive substance or mixture of chlorates or nitrates except as hereinafter provided.

The provisions of this chapter shall not apply to articles of the kind and nature herein mentioned which shall be in the possession of railroads or transportation companies for the purpose of transportation unless the same shall be held voluntarily by such railroads or companies as warehouse men; nor to signaling devices used by railroad companies nor to high explosives used for blasting or similar purposes, nor to any proper and lawful use of any rifle, gun, pistol or revolver by any person duly authorized by law to have or use the same nor to any lawful display or use of fireworks on the fourth day of July, commonly known as Independence Day.
No person, other than a duly authorized railway or railroad employee, shall place upon any street or other railway or railroad tracks, within the said portion of said Town, under any circumstances or at any time, any torpedoes, bomb or other thing containing any substance of any explosive nature.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes one or more persons of either sex, natural persons, corporations, partnerships, associations, joint stock companies, societies and all other entities of any kind capable of being sued.

A fee of $25 to be collected by the Town of Rye Police Department for services performed by the Rye Town Police Department in the investigation of those persons seeking to obtain a gun or pistol permit.
Any person who, himself or itself or by his or its agent or employee shall violate any of the provisions of this chapter, or any order, code, rule or regulation made in pursuance thereof, shall be liable to a penalty not exceeding in any one case of violation $50 to be recovered with costs, and shall upon conviction of such violation be subject to a fine of not less than $10 nor more than $50 or to imprisonment for not less than 10 days nor more than 50 days, or to both such fine and imprisonment, and each day on which such violation continues shall constitute a separate offense.
Any ordinance or part of any ordinance inconsistent with the provisions of this chapter is hereby repealed.
This chapter shall take effect at the earliest date allowed by law.
