This article creates, establishes and ratifies
the existence of a Police Department in the Borough of Haddonfield,
County of Camden, State of New Jersey, pursuant to N.J.S.A. 40A:14-118
et seq.
The Police Department shall preserve the public
peace; protect life and property; detect, arrest and prosecute offenders
of the laws of the State of New Jersey and the ordinances of the Borough
of Haddonfield; direct and control traffic; provide attendance and
protection during emergencies; provide appearances in court; cooperate
with all other law enforcement agencies; and provide training for
the efficiency of its members. (N.J.S.A. 40A:14-152)
The Borough Commissioner who is appointed as
the Director of Public Safety in accordance with state statute is
hereby designated as the Appropriate Authority as defined in N.J.S.A.
40A:14-118 et seq., who shall be responsible for the overall performance
of the Police Department. The Director of Public Safety shall promulgate
and adopt rules and regulations for the government of the Police Department
and for the discipline of Department members.
A. There is hereby created in and for the Borough of
Haddonfield a Police Department which shall consist of no more than
one Chief of Police, no more than one Captain, no more than two Lieutenants,
no more than five Sergeants, no more than five Corporals, and no more
than 12 police officers to be appointed to these positions by the
Appropriate Authority.

B. The Chief of Police shall be the head of the Police
Department and shall be directly responsible to the Appropriate Authority
for its efficiency and day-to-day operations. Pursuant to policies
established by the Appropriate Authority, the Chief of Police shall:
(1) Administer and enforce the Rules and Regulations of
the Police Department and any special emergency directive for the
disposition and discipline of the Department and its members and officers;
(2) Have, exercise and discharge the functions, powers
and duties of the Police Department;
(3) Prescribe the duties and assignments of all members
and officers;
(4) Delegate such authority as may be deemed necessary
for the efficient operation of the Police Department to be exercised
under the Chief's direction and control; and
(5) Report at least monthly to the Appropriate Authority
in such form as shall be prescribed on the operation of the Police
Department during the preceding month and make such other reports
as may be requested by the Appropriate Authority. (N.J.S.A. 40A:14-118)

In the event that a Chief of Police, Captain,
Lieutenant, Sergeant, or Corporal is unable to perform his/her duties
and obligations due to disability, illness, suspension, leave of absence,
military service, or other such reasons, then in such event the Director
of Public Safety may appoint an Acting Chief of Police, Acting Captain,
Acting Lieutenant, Acting Sergeant, or Acting Corporal as the need
exists.
A. The acting appointee shall be an individual appointed
from the next lower rank within the Haddonfield Police Department.
B. The acting appointee shall assume the duties and obligations
of the officer’s rank for whom the acting appointee was appointed
and shall receive the compensation for the rank to which he/she was
appointed as the acting appointee.
C. The acting appointee may serve in the acting position
until the duly appointed Chief of Police, Captain, Lieutenant, Sergeant,
or Corporal for whom the acting appointee was appointed resumes his/her
normal duties and obligations and then in such event the acting appointee
shall revert back to his/her former duties, obligations, title and
compensation; however, the acting appointee’s term shall not
exceed one year.

The Board of Commissioners of the Borough of
Haddonfield may appoint from time to time Special Law Enforcement
Officers, in accordance with N.J.S.A. 40A:14-146.11, for terms not
exceeding one year.
A. Class 1 (SLEO 1): Officers of this class shall be
authorized to perform routine traffic detail, spectator control and
similar duties. If authorized by ordinance, Class One officers shall
have the power to issue summonses for disorderly persons and petty
disorderly persons offenses, violations of municipal ordinances and
violations of Title 39 of the Revised Statutes. The use of firearms
by an officer of this class shall be strictly prohibited, and no Class
One officer shall be assigned any duties which may require the carrying
or use of a firearm.
B. Class 2 (SLEO 2): Officers of this class shall be
authorized to exercise full powers and duties similar to those of
a permanent, regularly appointed full-time police officer. The use
of a firearm by an officer of this class may be authorized only after
the officer has been fully certified as successfully completing training
as prescribed by the Police Training Commission.
The Board of Commissioners of the Borough of
Haddonfield may employ such other staff, such as clerks, secretaries,
dispatchers, etc., as the governing body deems necessary for the operation
of the Police Department. The duties, responsibilities, supervisors,
etc., of such civilian employees shall be identified in such civil
employees' title and job description.

A. Creation of positions. The positions of Parking Enforcement Officer
and Meter Control Officer are created. The number of Parking Enforcement
Officers and Meter Control Officers shall be determined by the Borough
Administrator. The compensation of Parking Enforcement Officers and
Meter Control Officers shall be set by the Salary Ordinance.
(1) Parking Enforcement Officers and Meter Control Officers shall possess
the power and authority, to the extent permitted by federal, state
and local law to:
(a)
Issue a parking ticket for a parking offense, as those two terms
are defined in the Parking Offenses Adjudication Act, P.L. 1985, c.
14 (N.J.S.A. 39:4-139.2 et seq.);
(b)
Serve and execute all process for any parking offense issuing
out of the court in the municipality having jurisdiction over the
complaint; and
(c)
Cause any vehicle parked, stored or abandoned in the municipality
in violation of a statute, resolution, ordinance or regulation to
be towed away from the scene of the violation at the vehicle owner's
expense and cause the vehicle to be stored at the vehicle owner's
expense.
B. Minimum qualifications. No person may be appointed as a Parking Enforcement
Officer or Meter Control Officer unless, at a minimum, the person:
(1) Is a resident of this state during the term of appointment;
(2) Is able to read, write and speak the English language well and intelligently;
(3) Is of sound mind and in good health;
(4) Is of good moral character; and
(5) Has not been convicted of any offense involving dishonesty or which
would make the person unfit to perform the duties of his office.
C. Compliance with additional state law requirements and procedures.
The appointment and qualifications of a Parking Enforcement Officer
and Meter Control Officer shall fully comply with all federal, state
and local laws.
No person shall be appointed to the Police Department
who is not qualified as provided by New Jersey statutes. The Appropriate
Authority may also require that an applicant for appointment to the
Police Department shall successfully complete a physical, mental and
psychological examination. (N.J.S.A. 40A:14-122 and N.J.S.A. 40A:14-147)
Disciplinary actions brought against any uniformed
officer of the Police Department shall be brought in accordance with
N.J.S.A. 40A:14-147 et seq.
The Borough Commissioner who is the Director
of Public Safety is empowered to hear and decide the charges made
against uniformed officers of the Police Department. The Director
of Public Safety shall prepare a report containing such findings of
fact, conclusions, and a final disposition of the charges. Such decision
by the Director of Public Safety shall be the final decision of the
Borough of Haddonfield. The Director of Public Safety in his/her discretion
may select an officer to serve in place of the Director of Public
Safety. Such hearing officer shall conduct a hearing, then submit
a report to the Director of Public Safety containing findings of fact,
conclusions and, if requested by the Director of Public Safety, a
recommended disposition of the charges to be acted upon by the Director
of Public Safety as the final decision of the Borough of Haddonfield.
The final decision of the Director of Public
Safety may be reviewed on appeal in the Superior Court in accordance
with N.J.S.A. 40A:14-150.
The Director of Public Safety (who is the Appropriate
Authority as referred to in N.J.S.A. 40A:14-118) shall promulgate
and adopt the Rules and Regulations for the Police Department consistent
with this article, state law and federal law.
The Rules and Regulations of the Police Department
to be promulgated and adopted shall provide for the governance of
the Police Department and shall further provide for the discipline
of the Police Department members.

Pursuant to the provisions of N.J.S.A. 40A:14-156,
the governing body of the Borough of Haddonfield hereby agrees to
the provision of reciprocal police assistance, as hereinafter provided,
with those municipal corporations in Camden County and in those counties
contiguous to Camden County which demonstrate their reciprocity by
their enactment of this article.
It is hereby expressly provided that upon committing
such reciprocal police assistance, as hereinafter provided, no payment
shall be required to be made by the assisted municipality to the municipality
providing such assistance. This exclusion will include (but is not
necessarily limited to) police salaries, cost of automobiles or motorcycles,
use of police dogs, and/or the cost of other equipment or expenses
incurred by providing such assistance. This provision of nonpayment
is in lieu of those rates of pay and rentals set forth in N.J.S.A.
40A:14-156 and as required by law.
Any of the concurring parties may withdraw from
and terminate their part in this agreement at the end of any calendar
year, provided that notice of such intention to terminate shall be
given no later than November 1 of each year to each participant herein.
Otherwise, the agreement shall remain in force on a yearly basis.
The Mutual Aid Operations Plan promulgated by
the Camden County Chiefs of Police Association proscribing the specifics
of emergency reciprocal police assistance is hereby incorporated by
reference without inclusion herein. Such Mutual Aid Operations Plan
will be periodically updated, but such updated version will not be
enacted until distributed to each and every party hereto for their
edification and whatever action they may deem appropriate.
The Chief of Police shall annually, and as soon
after the end of the year as practicable, furnish the respective governing
body with a summary report of services rendered and received with
his comments and recommendations.
